July 28. 2009

Background:
. Ebony Heights is one of the four priority neighborhoods on the original list to
receive neighborhood drainage and street improvements.
. This phase of the improvement project for Ebony Heights will provide a drainage
outfall for the neighborhood.

Discussion:
. The low bid was less than half the Engineer's estimate. Fourteen out of 17 bids
were below the Engineer's estimate. The project costs are based on unit prices and
could be expanded at the bid rate.
. At the civic league meeting where the project was presented to the
neighborhood, the majority expressed a desire to have the old rail road right of way
piped instead of a ditch as designed. Piping this ditch was to be a part of future phases.
. The estimate to perform this work based on unit prices provided by the low
bidder is still within limits of the project budget. Additionally, the combined total is still
within the original Engineer's estimate and budget.

Financial Impact:
. Monies were budgeted for this project in the current capital improvements plan.
The current contract amount is $756,733.58. Sufficient funds are available in the
Capital Budget to cover the amount of this change order which is approximately
$350,000. Most current available project budget is $1,764,847.

Recommended Action:
. Request approval to exceed the 25% limit of allowable change orders to the
Ebony Heights Neighborhood Improvements contract due to favorable bids and to
capitalize on the opportunity to significantly increase the original size of the project.
Vision Principle: Thriving Neighborhoods and a Sense of Community.

1. Timothy Faesi, 5521 Pond Lane, spoke in opposition to this item.

2. Maxine Simms, 3520 Wright Road, spoke in opposition to this item.

Motion by Mr. Whitehurst, and seconded by Ms. Randall, to defer consideration
of Item 09-394 to the September 8, 2009 City Council Meeting, and was adopted by the
following vote:

Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley
Nays: None

09 - 395 - Adoption of an ordinance to appropriate in the FY 2009-2010 Capital
Improvements Fund the sum of $891,500 received from the Federal Highway
Administration through the Congestion Mitigation and Air Quality program (CMAQ) to
replace the traffic signalization at the Alexander's Corner intersection. Vision Principle:
Thriving Neighborhood and Sense of Community.

Background:
. September 25, 2007 City Council approved a resolution authorizing the City
Manager to execute a Project administration agreement VDOT for the CMAQ
funding.

Discussion:
. These funds will be combined with $1.5 million in CMAQ funds received for
signalization of the Airline Blvd corridor to the western city limits.
. Appropriation of the subject funds is necessary to proceed with the project.

Financial Impact:
. There is no city match required for the receipt of the $891,500 in CMAQ funding.
