Motion by Ms. Psi mas, and seconded by Mr. Moody, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE TO REPROGRAM $200,000 WITHIN THE FY 2008-2009 CAPITAL IMPROVEMENTS FUND AND TO APPROPRIATE SAID SUM IN THE FY 2009-2010 CAPITAL IMPROVEMENTS FUND FOR A SKATE PARK IN CRADOCK." Ayes: Moody, Heretick, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None 09 - 366 - Adoption of an ordinance (A) to amend Chapter 19 of the Code of the City of Portsmouth, Virginia (2006) by adopting a new Section 19-20 and by amending Appendix A thereof to establish a library card fee for certain non-resident library patrons and (B) to establish a Library Special Revenue Fund for such fees. During FY2009-2010 budget discussions, council suggested charging non- resident fees for patrons using the Portsmouth Public Libraries. . Staff researched other City policies and sent a draft non-resident fee policy to the Portsmouth Public Library Board. o The draft was reviewed at the May 14 Board meeting and adopted at the June 11, 2009 Board meeting. o The Policy is as follows: Portsmouth Public Library Fees for Service: Non-Resident Card Policy The Portsmouth Public Library offers access to a comprehensive collection of materials, in a safe and appealing environment, to encourage social, economic, cultural, and intellectual growth to meet the ever-changing needs of the citizens of Portsmouth. Effective July 28, 2009, for Virginia residents who do not live, own property, operate a business in, or work for the City of Portsmouth, or TCC students, a non-resident card with an annual non-refundable fee of $10.00 will be available. The City of Portsmouth will operate under an implied reciprocity agreement with residents from Hampton Roads cities. As such, so long as Portsmouth residents are not charged a non-resident fee for access to library material at the other City's public library, the City of Portsmouth will allow residents from that City to utilize Portsmouth Public Library materials without being charged a non-resident fee. A Library special designated revenue fund will be established for the revenue. The non-resident card provides the same borrowing privileges as Portsmouth residents - - including holds, interlibrary loans, reserve meeting rooms (applicable fees apply), and access to electronic resources.
