35O <br /> <br />August 28, 1990 <br /> <br /> (2) Environmental controls, including air and <br />water monitoring equipment, to be provided to avoid <br />negative environmental impacts of the facility, which <br />can result if permit requirements and regulatory <br />approvals are not met; and <br /> <br /> (3) Site plan requirements of the Zoning <br />Ordinance, the Chesapeake Bay Preservation Act and <br />regulations, and related City ordinances. <br /> <br /> (d) A landscaping plan must be approved bY the Director <br />of Planning prior to the~approval of the site plan. The <br />landscaping plan must comply with the requirements of Chapter 36 <br />of the City Code, as amended, regarding tree retention or <br />replacement and must meet the following additional standards: <br /> <br /> (1) Any parking area, sCales, unloading areas, or <br /> equipment must be screened from view from any public <br /> street by a berm, landscaping screen, wall, or any <br /> combination thereof <br /> <br /> (2) The plan shall ident~ify landscape focai~ <br /> points at entrances and other areas visible from <br /> public streets. These focal points shall be <br /> landscaped with a combination of deciduous and <br /> coniferous trees and shrubs. <br /> <br /> (e) PriOr to commencement of any operation on the subject <br />property, the operator of this facility shall provide evidence <br />of compliance with all applicable conditions of this use permit <br />to the City Manager of the City of Portsmouth or his designee. <br /> <br /> (f) The aPpiiCant or its assignee(s) or successor(s) <br />shall be required to demonstrate compliance on a periodic basis, <br />and at all times shall comply, with all applicabl~ statutes, <br />codes, ordinances, policies and regulations of federal, state <br />and local governments or agencies that govern the subject use, <br />and Shall Obtain all necessary licenses and permits required by <br />law fOr this use prior to the commencement of operations. The <br />applicant or its assignee(s) or successor(s) Shall submit <br />written documentation of compliance with State air and water <br />quality standards as required by the State Air Pollution~Control <br />Board a~d th~ State water Control Board or their successors on a <br />quarterly basis~ The plant shall be equipped with a continuous <br />emission monitoring system, and the applicant or its assignee(s) <br />or succeSsor(s) shall retain all records of emissions for no <br />less than two years for t.he purpose of inspection by the City of <br />pOrtsmouth at any time. <br /> <br /> (g) If violations of the conditions of this use permit <br />occur, the City Manager of the City of Portsmouth or his <br />designee shall be empowered to require that operation of the <br />facility, or any part thereof, be discontinued until proper <br />corrective action has been taken. <br /> <br /> (h) No deliveries of materials or supplies or trash, <br />garbage, refuse or municipal solid waste will be permitted <br />between the hours of 5:00 p.m. and 7:00 a.m., and no deliveries <br />will be permitted on Sundays. The City Manager, upon <br />recommendation by the City Traffic Engineer, may modify the <br />terms of this condition, provided that: <br /> <br />(1) The City Manager or his designee will provide <br />the operator of this facility and the Cradock <br />Property Owners Assoc%ation and the Cradock Area <br />Civic Coalition thirty (30) days advance notice of <br />the effective date of modification, and <br /> <br /> <br />
