August 28, 1990 349 BE IT RESOLVED by the Council of the City of Virginia, that: The use for which the use permit hereinafter described (a) Will not adversely affect the health and safety of ons residing or working in the neighborhood of the osed use; (b) Will not be detrimental to the public use or rious to the property or improvements of the proposed hborhood; and (c) Will be in accordance with the purposes of the ng Chapter of the City Code. Wheelabrator Technologies, Inc. is hereby granted a use pursuant to Section 40-69[b) of the Code of the City Virginia, 1988, for the operation of a garbage incinerator on property located at 1141 Victory evard, Portsmouth, Virginia and being more particularly ribed as: UP-90-13 Beginning at the intersection of the smouth-Chesapeake corporate boundary and the east t-of-way line of Victory Boulevard; thence northeasterly the east right-of-way line of Victory Boulevard 1,770'~ thence easterly 640'~ to the western line of Creek; thence in a southerly and easterly direction said creek line a distance of 525'+ to a point; thence 1,130'+ to the Portsmouth-Chesapeake corporate dary line; thence along said boundary 1,740'~ to the east t-of-way line of Victory Boulevard, the point of origin. This use permit is approved subject to the following s: (a) The cost of any improvements or modifications to ic water lines, sanitary sewerage or sewage treatment lities directly generated by this project will be paid by applicant or its assignee(s) or successor(s). The ctor of Public Utilities may require the applicant or its gnee(s) or successor(s) to provide studies documenting ected City water requirements. (b) The facility shall be constructed and operated in ,rdance with the document entitled "Wheelabrator Tidewater ect Summary, UP-90-13~ Exhibit 1", submitted by the icant, unless otherwise modified by conditions contained ~ln or by an alternate acceptable to the City Council. .hermore, the operator of the facility shall upgrade and 'ofit the facility to comply with the future requirements state and federal environmental protection agencies, the State Air Pollution Control Board and the State Water ~rol Board, or their successors, as they are enacted into In addition, the operator of the facility must install utilize during all hours of plant operation (i) a de-NOx :em, (ii) a continuous Emissions Monitoring System, and .) a spray dryer absorber (wet scrubber).
