August 28, 1990 <br /> <br />349 <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Virginia, that: <br /> <br />The use for which the use permit hereinafter described <br /> <br /> (a) Will not adversely affect the health and safety of <br />ons residing or working in the neighborhood of the <br />osed use; <br /> <br /> (b) Will not be detrimental to the public use or <br />rious to the property or improvements of the proposed <br />hborhood; and <br /> <br />(c) Will be in accordance with the purposes of the <br />ng Chapter of the City Code. <br /> <br /> Wheelabrator Technologies, Inc. is hereby granted a use <br /> pursuant to Section 40-69[b) of the Code of the City <br /> Virginia, 1988, for the operation of a garbage <br />incinerator on property located at 1141 Victory <br />evard, Portsmouth, Virginia and being more particularly <br />ribed as: <br /> <br />UP-90-13 <br /> <br /> Beginning at the intersection of the <br />smouth-Chesapeake corporate boundary and the east <br />t-of-way line of Victory Boulevard; thence northeasterly <br /> the east right-of-way line of Victory Boulevard 1,770'~ <br /> thence easterly 640'~ to the western line of <br /> Creek; thence in a southerly and easterly direction <br /> said creek line a distance of 525'+ to a point; thence <br /> 1,130'+ to the Portsmouth-Chesapeake corporate <br />dary line; thence along said boundary 1,740'~ to the east <br />t-of-way line of Victory Boulevard, the point of origin. <br /> <br />This use permit is approved subject to the following <br />s: <br /> <br />(a) The cost of any improvements or modifications to <br />ic water lines, sanitary sewerage or sewage treatment <br />lities directly generated by this project will be paid by <br />applicant or its assignee(s) or successor(s). The <br />ctor of Public Utilities may require the applicant or its <br />gnee(s) or successor(s) to provide studies documenting <br />ected City water requirements. <br /> <br /> (b) The facility shall be constructed and operated in <br />,rdance with the document entitled "Wheelabrator Tidewater <br />ect Summary, UP-90-13~ Exhibit 1", submitted by the <br />icant, unless otherwise modified by conditions contained <br />~ln or by an alternate acceptable to the City Council. <br />.hermore, the operator of the facility shall upgrade and <br />'ofit the facility to comply with the future requirements <br />state and federal environmental protection agencies, <br />the State Air Pollution Control Board and the State Water <br />~rol Board, or their successors, as they are enacted into <br /> In addition, the operator of the facility must install <br />utilize during all hours of plant operation (i) a de-NOx <br />:em, (ii) a continuous Emissions Monitoring System, and <br />.) a spray dryer absorber (wet scrubber). The project <br />.1 also be constructed in accordance with the Conceptual <br /> Plan labeled UP-90-13, Exhibit 2. <br /> <br /> (c) Prior to approval of a plan of development (site <br /> ), the applicant or its assignee(s) or successor(s) shall <br />~ent engineering drawings and related documents acceptable <br />~he City Manager of the City of Portsmouth or his <br />_gnee, which shall address: <br /> <br />(1) The construction and operation of the facility; <br /> <br /> <br />
