<br /> Motion of Mr. Hawks and seconded by Mr. Epperson to
<br />approve the following resolution with an amendment to the second
<br />sentence of condition 3 (b) of the use permit, and was adopted
<br />by the following vote:

<br /> "A RESOLUTION GRANTING A USE PERMIT TO WHEELABRATOR
<br />TECHNOLOGIES, INC. FOR THE OPERATION OF A GARBAGE AND WASTE
<br />INCINERATOR AT 1141 VICTORY BOULEVARD, PORTSMOUTH, VIRGINIA.
<br />
<br /> WHEREAS, Wheelabrator Technologies, Inc. has made
<br />application pursuant to Section 40-69(b) of the Code of the City
<br />of Portsmouth, virginia, 1988, for the granting of a use permit
<br />as hereinafter described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done
<br />all things required to be done in connection with said
<br />application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the
<br />granting of said use permit with conditions.
