352 <br /> <br />August 28~ 1990 <br /> <br /> (n) The applicant, or its assignee(s) or successor(s) <br />within one hundred and eightY (180) days of the adoption of this <br />resolution, or within such additional time as the City Manager <br />or his designee may grant, shall execute an agreement with <br />Southeastern Public Service Authority (SPSA), or its successor, <br />for the procurement of the trash, garbage, refuse, ~r municipal <br />solid waste referred to in condition (1) above. <br /> <br /> (o) The fac~lit~ shail be construct'ed in ac¢ordance~with <br />the exterior architeCtural design~ and color rendering set out in <br />the document labeled UP-90-13, Exhibit 5. ~ <br /> <br /> (p) The applicant within thirty days of the adoption ~of <br />this resolution shall execute an agreement with the City to pay <br />up to 25% of the total cost or $300,000.00, whiche.ver iB l~ss, <br />for repair or reConstrUction of the Paradise Creek Bridge on <br />Victory Boulevard, The cost of r~pair or reconstruction shall <br />include design and engineering, soil surveys, permit~and <br />inspectiOn fees, and any costs involved in securing approval of <br />the Army Corps of Engineers, Virg~inia Marine ResourCes <br />Commission, Virginia Department of Transportation, and City of <br />PortsmOuth wetlands Board, <br /> <br /> (q) The applicant, or its assignee(s) or Successor(s), <br />shall participate with the City in a plan of public education <br />concerning recycling and in the establishment of recycling <br />centers in the City of Portsmouth. <br /> <br /> (r) The applicant, or its assignee(s) or successor(s), <br />shall participate with the citizens of Cradock in the location <br />and installation of Community and recreational improvements. <br /> <br /> (s) Prior to commencement of any operation of the <br />facility, the operator of this facility shall provide the City <br />Manager of the City of Portsmouth or his designee, with an <br />emergency evacuation Plan and evidence of a fire contingency and <br />supression plan which meets with the approval of the City <br />Manager or his designee(s). ~ <br /> <br /> (t) The plant shall be equipped with a fire supression <br />system adequate to extinguish fires on the tipping floor or in <br />the garbage pit. The plant shall have its own firefighting <br />personnel on duty at~alt times. <br /> <br /> (u) If any condition ef this use permit is for any reason <br />declared invalid by a court of law, such decision shall not <br />affect the validity and enforceability of the remaining <br />conditions." <br /> <br /> Ayes: Epperson, King, Hawks, LuCas, Webb <br /> Nays: Clemons, Corprew <br /> <br />- REPORTS FROM THE CITY MANAGER - <br /> <br /> 90-358 Letter from the City Manager recommending adoption <br />of an ordinance to appropriate $249,782 from the Public Utility <br />Capital Improvement Fund for design and construction services <br />for the installation of the new Churchland transmission main, <br />and permission to execute contracts with HDR Engineering, Inc. <br />and CH2M-Hill. <br /> <br /> "After going through a formal selection process and <br />negotiations, the Director of Public Utilities has recommended <br />that Portsmouth retain the engineering firms of HDR Engineering, <br />Inc. and CH2M-Hitl for the new Parallel Churchland Transmission <br />Main Project. I concur in this recommendation and seek your <br />approval to execute the contracts with these firms and <br />appropriate $249,782.00 from the Public Utility CaPital <br />Improvement Fund to begin this project. A breakdown of these <br />fees and services follows. <br /> <br /> <br />
