Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None 09 - 232 - Adoption of an ordinance to amend Chapter 11 of the Code of the City of Portsmouth, Virginia (2006) by amending Sections 11-2, 11-3, and 11-4 thereof pertaining to erosion and sediment control. The Virginia Department of Conservation & Recreation (DCR) implemented State Erosion & Sediment Control (E&SC) regulations in the mid seventies, requiring cities to implement E&SC programs to protect state waters by minimizing the amount of sediment loss due to erosion from construction sites. The Virginia Erosion & Sediment Control Law (VESCL) requires that DCR periodically conduct program reviews of all local programs and assess them for effectiveness and conformance with the state program. . The City's E&SC program was reviewed by DCR on January 6, 2009 and found to be consistent with the state-mandated program, but the agency requires minor changes to the City's ordinance to match recent changes to the state code. Discussion: . The Engineering Department hereby requests the Portsmouth City Council to approve the required Code changes. Financial Impact: . Implementation of the City's Erosion Control program is primarily funded through the City's Stormwater Utility.
