Lee Cherry, 1108 Melvin Drive, spoke in support of this item. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE APPROPRIATING $500,000 IN THE FY 2008-2009 DONATIONS <br />FUND FOR THE CONTINUED OPERATION OF THE COMMUNITY ENFORCEMENT <br />UNIT PROGRAM." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />09 - 232 - Adoption of an ordinance to amend Chapter 11 of the Code of the City of <br />Portsmouth, Virginia (2006) by amending Sections 11-2, 11-3, and 11-4 thereof <br />pertaining to erosion and sediment control. Vision Principles: Pride of Past, Promise of <br />Future. <br /> <br />Background: <br />. The Virginia Department of Conservation & Recreation (DCR) implemented State <br />Erosion & Sediment Control (E&SC) regulations in the mid seventies, requiring cities to <br />implement E&SC programs to protect state waters by minimizing the amount of <br />sediment loss due to erosion from construction sites. The Virginia Erosion & Sediment <br />Control Law (VESCL) requires that DCR periodically conduct program reviews of all <br />local programs and assess them for effectiveness and conformance with the state <br />program. <br />. The City's E&SC program was reviewed by DCR on January 6, 2009 and found <br />to be consistent with the state-mandated program, but the agency requires minor <br />changes to the City's ordinance to match recent changes to the state code. <br /> <br />Discussion: <br />. The Engineering Department hereby requests the Portsmouth City Council to <br />approve the required Code changes. <br /> <br />Financial Impact: <br />. Implementation of the City's Erosion Control program is primarily funded through <br />the City's Stormwater Utility. There will be no financial impact by incorporating the <br />required changes into the City's E&SC ordinance. <br /> <br />Staff Recommends: <br />. Adoption of code changes.
