That the use permit is approved subject to the following conditions which shall be <br />observed by the applicant and any successor in interest: <br /> <br />(a) Days and hours of operation shall be daily between the hours of 6:00 a.m. and <br />2:00 a.m. <br /> <br />(b) Seating shall be limited to thirty-two (32) seats in the restaurant at anyone time. <br /> <br />(c) Eight on-site parking spaces shall be marked for use by the restaurant. These <br />spaces shall be located within the paved and striped parking area. <br /> <br />(d) The applicant shall obtain and maintain in effect all required permits and licenses <br />for the establishment. <br /> <br />(e) The proposed business shall operate in accordance with federal, state and local <br />statutes, ordinances, and regulations. <br /> <br />(f) The applicant shall continue the use of a commercial waste hauler to dispose of <br />trash and other waste generated by the restaurant. <br /> <br />(g) The owner/developer shall be responsible for upgrades to water and sewer, as <br />necessary, including the installation of a backflow preventer device approved by the <br />Public Utilities Department. <br /> <br />(h) All taxes in connection with the proposed use shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />09 - 231 - Adoption of an ordinance appropriating $500,000 in the FY 2008-2009 <br />Donations Fund for the continued operation of the Community Enforcement Unit <br />Program. Vision Principle: Thriving Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. Traditionally Public Safety Services have been provided by the Police <br />Department - criminal law enforcement, Fire Dept - fire fighting and safe havens, and <br />Sheriff's Office - Court Services / Jail Admin and law enforcement. <br />. The Code of Virginia recognizes the Sheriff as the conservator of the peace, <br />charged with the enforcement of all criminal laws within his jurisdiction. This duty, <br />coupled with the duty of the Police Department of a given county, city or town, <br />authorizes the investigation of all violations of the law and service of criminal warrants. <br />. The CEU Pilot Program was created and has enhanced the partnership between <br />all Public Safety Agencies to provide a safer Portsmouth. <br />. The CEU Pilot Program has displayed a collaborative partnership between the <br />Police, Civic Groups, Neighborhood Watch, etc., in enhancing the quality of life for our <br />Portsmouth Family. <br /> <br />Discussion: <br />. The CEU is a program whose time has come. The program has worked with the <br />cooperative efforts of the Police Department and the Sheriff's Office. Crime has been <br />reduced in several neighborhoods. The Citizens will benefit from this program being <br />made a regular part of the Sheriff's Office. The CEU's efforts will continue to be <br />neighborhood enforcement with an increased effort in the gang task force area. <br />
