April 14. 2009 Motion by Mr. Smith, and seconded by Mr. Whitehurst, to defer consideration of Item 09-88 to the July 28, 2009 City Council Meeting, and was adopted by the following vote: Ayes: Psimas, Randall, Smith, Whitehurst, Holley Nays: None - City Manager's Report - 09 - 199 - Adoption of an ordinance to amend Chapter 9 of the Code of the City of Portsmouth, Virginia (2006) by amending Section 9-1 thereof pertaining to cemeteries. Vision Principle: Bold New Directions. Background: . The current Section 9-1 a makes no provision for establishment or enlargement of cemeteries within the City. . The suggested amendment to the Code would provide the City the opportunity to explore the possibility of creating more space for burial within the City's limits. . The suggested amendment would provide private persons and/or entities to explore the possibilities of providing more burial space within the City's limits. Discussion: . Financial Impact: There is the possibility of the donation of property to City for Cemetery use, if this amendment is adopted. Recommended Action: . Adoption of an ordinance amending Section 9-1 a Code to provide that cemeteries may be established or enlarged in the City except as otherwise permitted by City Council through a rezoning of the subject property to Conditional Preservation P-1 District. Vision Principal: Bold New Directions by facilitating future development of City facilities. Next Steps following City Council Action: . The City will entertain applications to enlarge or establish additional cemetery space in compliance with the amended code. Motion by Mr. Whitehurst, and seconded by Mr. Smith, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE TO AMEND CHAPTER 9 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 9-1 THEREOF PERTAINING TO CEMETERIES." Ayes: Psimas, Randall, Smith, Whitehurst, Holley Nays: None 09 - 200 - Adoption of an ordinance accepting a McKinney-Vento Act Homeless Assistance Competition Grant in the amount of $457,513 from the U.S. Department of Housing and Urban Development and appropriating said funds in the FY 2008-2009 Grants Fund to be used by the Department of Behavioral Healthcare Services for the Shelter Plus Care Grant and Supportive Housing Program. Vision Principle: Thriving Neighborhoods and a Sense of Community. Background: . HUD selected the DBHS to receive $388,500 for the Shelter Plus Care Grant and $69,013 for Supportive Housing Program Grant for a total of $457,513.
