January 13. 2009

Ayes: Heretick, Moody, Randall, Smith, Whitehurst, Holley
Nays: None
(Ms. Psi mas was absent during vote)

09 - 22 - Adoption of an ordinance authorizing the transfer from the Capital
Improvements contingency of $95,000 to the Seawall repair project and $75,000 to the
Churchland High School HVAC project. Vision Principle: Thriving Neighborhoods and
a Sense of Community.

Background:
. Council action of June 24, 2008 redistributed Capital Improvement funds
between the neighborhood projects leaving $170,451 in a contingency to be designated
for a specific project or projects at some time in the future.

Discussion:
. On our waterfront seawall repair project work has uncovered a section of the
seawall walkway deck that is beyond reasonable repair necessitating complete
replacement of a walkway section. The section requiring replacement is located
adjacent to the Renaissance Hotel in the north inlet. This is not part of the seawall
scheduled for replacement in the Capital Improvements Program behind the former
Holiday Inn. Cost of the replacement will require an additional $95,000.
. On the Churchland High School work is presently near completion on the last
phase of a four phase project to retrofit the HVAC system to correct air quality problems
that resulted from the code under which the school was designed and built. An
additional $75,000 is needed to complete the necessary inspection, testing and
balancing of the equipment added to the system as well as necessary additions and
adjustments to complete the tie ins to the existing system.

Financial Impact:
. The cost of the two items can be funded by the contingency amount identified in
the Capital Improvement program.

Recommended Action:
. Approval of an ordinance authorizing the transfer from the Capital Improvements
contingency of $95,000 to the Seawall repair project and $75,000 to the Churchland
High School HVAC project. Vision Principle: Thriving Neighborhoods and a Sense of
Community.

Next Steps Following Council Action:
. Authorize the contractors on these two projects to proceed with completion of the
necessary work.

Motion by Mr. Whitehurst, and seconded by Mr. Smith, to adopt the following
ordinance, and was adopted by the following vote:

"ORDINANCE AUTHORIZING THE TRANSFER FROM THE FY 2008-2009 CAPITAL
IMPROVEMENTS FUND CONTINGENCY ACCOUNT OF $95,000 TO THE SEAWALL
REPAIR PROJECT AND $75,000 TO THE CHURCHLAND HIGH SCHOOL HVAC
PROJECT."

Ayes: Heretick, Moody, Randall, Smith, Whitehurst, Holley
Nays: None
(Ms. Psi mas was absent during vote)

09 - 23 - Adoption of a resolution authorizing a Law Enforcement Mutual Aid
Agreement. Vision Principle: Bold New Directions.
