<br />January 13. 2009 <br /> <br />Background: <br />. For many years, Law Enforcement agencies through the Hampton Roads region <br />have entered into Mutual Aid Agreements to authorize interjurisdictional assistance and <br />cooperation. The proposed agreement merely updates prior agreements. <br /> <br />Discussion: <br />. The localities that will be parties to the agreement are Chesapeake, Hampton, <br />Newport News, Norfolk, Poquoson, Portsmouth, Suffolk, Virginia Beach, Williamsburg, <br />James City County, Isle of Wight County, York County, and Smithfield. <br />. The agreement authorizes voluntary inter-jurisdictional assistance and <br />cooperation between law enforcement agencies. <br />. The law enforcement agency of the host locality will remain in charge of all <br />criminal investigations and prosecutions within that locality's jurisdiction. <br />. Financial Impact: No material financial impact. <br /> <br />Recommended Action: Adoption of the resolution is recommended. Vision Principle: <br />Bold New Directions. <br /> <br />Next Steps Following Council Action: <br />. Manager to sign Agreement. <br />. Agreement to implement by Portsmouth Police Department. <br /> <br />Motion by Mr. Heretick, and seconded by Ms. Randall, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING A LAW ENFORCEMENT MUTUAL AID <br />AGREEMENT. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager is authorized and directed to sign a Law Enforcement Mutual Aid <br />Agreement that is substantially the same as the one attached to this resolution and <br />identified as Exhibit A. <br /> <br />BE IT FURTHER RESOLVED that this resolution shall be effective upon the date <br />of its adoption." <br /> <br />Ayes: Heretick, Moody, Randall, Smith, Whitehurst, Holley <br />Nays: None <br />(Ms. Psi mas was absent during vote) <br /> <br />09 - 24 - Adoption of a resolution approving the exercise by the Economic <br />Development Authority of the City of Portsmouth, Virginia of powers conferred by the <br />Industrial Development and Revenue Bond Act, in conjunction with the issuance for <br />Victory Conference Center Hotel, LLC, a Virginia Limited Liability Company, of not to <br />exceed $26,600,000 of the authority's tax-exempt revenue bonds to finance a portion <br />of (1) the cost of a 200 room limited full-service hotel, and the land associated <br />therewith, (2) a Debt Service Reserve Fund, (3) Capitalized Interest, and (4) the costs <br />of issuing such bonds, and designating $23,600,000 of such bonds as New <br />Empowerment Zone Facility Bonds for purposes of section 1394(F)(2)(A) of the <br />Internal Revenue Code of 1986, as amended. Vision Principle: A Robust and <br />Prospering Economy. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Moody, to defer consideration of <br />Item 09-24 to the January 27, 2009 City Council Meeting at the request of the <br />applicant's Bond Counsel, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Smith, Holley <br />Nays: None <br />Abstain: Randall, Whitehurst (Per the advisement of the Commonwealth Attorney) <br />
