Vision principle: Thriving Neighborhoods and a Sense <br />of Community <br /> <br />Next Steps Following Council Action: <br />. The Director will ensure that the budget action required to increase the total <br />appropriations and estimated revenues in the Behavioral Healthcare Services by <br />$3,000.00 is processed immediately upon adoption of the ordinance. <br /> <br />Motion by Ms. Randall, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND THE FY 2008-2009 FUNDING FOR ONE-TIME ONLY <br />RESIDENTIAL START UP COST FROM THE VIRGINIA DEPARTMENT OF MENTAL <br />HEALTH, MENTAL RETARDATION, AND SUBSTANCE ABUSE SERVICES <br />(DMHMRSAS) TO THE PORTSMOUTH DEPARTMENT OF BEHAVIORAL <br />HEAL THCARE SERVICES (DBHS) IN THE AMOUNT OF $3,000 FOR PERSONS <br />WITH MENTAL RETARDATION WHO WERE GIVEN A MEDICAID HOME AND <br />COMMUNITY BASED WAIVER SLOT." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />09 - 21 - Adoption of an ordinance renewing the City's telecommunications franchise <br />with Verizon Virginia, Inc., to allow them to continue to occupy, construct and maintain a <br />telecommunications system in the City of Portsmouth. Vision Principle: Bold New <br />Directions. <br /> <br />Background: <br />. Verizon Virginia, Inc. has proposed a renewal of its telecommunications franchise <br />pursuant to sections 15.2-2100 and 56-462 of the Code of Virginia. <br /> <br />Discussion: <br />. The General Assembly adopted section 15.2-200 and 56-462 of the Code of <br />Virginia to regulate the occupation and use of the public rights of ways in connection <br />with the construction, maintenance and repair of telecommunications systems. In <br />accordance with this law, Verizon Virginia, Inc., has requested a renewal of its <br />telecommunications franchise in the City and has provided a bid for an ordinance <br />granting them a telecommunications franchise for adoption. <br /> <br />Financial Impact: <br />. None. This is an ordinance which will govern the occupation and use of the <br />public rights of ways in the City in connection with the construction, maintenance and <br />repair of Verizon Virginia, Inc. telecommunication systems. <br /> <br />Staff Recommends: <br />. Adoption of ordinance. Vision Principle: Bold New Directions. <br /> <br />Next Steps Following Council Action: <br />. The City Manager will have the authority to sign the telecommunications <br />franchise and Verizon may continue to maintain its telecommunications systems and <br />therefore offer its services to the citizens of Portsmouth. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Heretick, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE RENEWING THE CITY'S TELECOMMUNICATIONS FRANCHISE <br />WITH VERIZON VIRGINIA, INC., TO ALLOW VERIZON VIRGINIA, INC., TO <br />CONTINUE TO OCCUPY, CONSTRUCT AND MAINTAIN A <br />TELECOMMUNICATIONS SYSTEM IN THE CITY OF PORTSMOUTH." <br />
