The grant award amount is $4,025.51 of Department of Justice funds for the <br />purchase of bulletproof vests for Portsmouth Police and Sheriff's Department. The City <br />has no obligation once the grant has ended. <br /> <br />Staff Recommends: <br />. Adoption of an ordinance to appropriate $4,025.51 from the Department of <br />Justice - Bureau of Justice Assistance to provide funds to reimburse 50% of the cost <br />expended for the purchase of bulletproof vests for the police department and Sheriff's <br />Office personnel working on the streets. The Chief of Police or his designee will provide grant management and oversight. <br /> <br />Motion by Ms. Randall, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO ACCEPT A GRANT IN THE AMOUNT OF $4,025.51 FROM THE <br />U.S. DEPARTMENT OF JUSTICE BUREAU OF JUSTICE ASSISTANCE AND TO <br />APPROPRIATE SAID FUNDS IN THE FY 2008-2009 GRANTS FUND FOR THE <br />PURPOSE OF PROVIDING 50% FUNDING FOR THE PURCHASE OF <br />BULLETPROOF VESTS FOR POLICE DEPARTMENT AND SHERIFF'S <br />DEPARTMENT PERSONNEL." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />08 - 529 - Adoption of an ordinance to renew the City's cable franchise with Cox <br />Communications Hampton Roads, L. L. C., allowing the company to construct, operate, <br />and maintain a cable system in the City of Portsmouth. Vision Principle: Bold New <br />Directions. <br /> <br />Background: <br />. Cox Communications Hampton Roads, LLC. has proposed a renewal of its cable <br />franchise pursuant to sections 15.2-2108.21 and 15.2-2108.22 of the Code of Virginia. <br /> <br />Discussion: <br />. The General Assembly adopted section 15.2-2108.21 Ordinance Cable <br />Franchise, thereby allowing entrance into the marketplace of new cable providers. In <br />accordance with this law, Cox Communications Hampton Roads, LLC. has requested a <br />renewal of its cable franchise in the City and has provided a proposed cable franchise <br />for adoption. <br /> <br />Financial Impact: <br />. Cox Communications Hampton Roads, LLC, will provide to the City a Public, <br />Educational and Governmental (PEG) Capital Grant Surcharge Fee to the City in the <br />amount of $.35/ per subscriber on a quarterly basis for five (5) years, $.45/per <br />subscriber for the next five (5) years and $.50/per subscriber for the last five (5) years of <br />the fifteen (15) year franchise. <br />. Cox Communications Hampton Roads, LLC. will provide to the City a franchise <br />fee on a quarterly basis which will be equal to 5% of Cox's gross revenues or such other <br />amount which may be subsequently permitted by state or federal law. <br /> <br />Staff Recommends: <br />. The City Manager will have the authority to sign the ordinance cable franchise <br />and Cox may continue offering its services to the citizens of Portsmouth. <br />
