September 23. 2008 Motion by Mr. Whitehurst, and seconded by Mr. Smith, to concur with the recommendation of the Planning Commission that UP-08-10 be approved on first reading, and was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None (c) UP-08-15 PORT NORFOLK COMMERCIAL CORRIDOR - L. Louise Lucas requests a use permit to operate an adult day support program and residential care facility at 2700 London Boulevard. The Comprehensive Plan's Generalized Future Land Use Map recommends institutional and public uses in the area. Vision Principle: Bold New Directions. 1. Clifford Kalmbach, 3702 Magnolia Drive, spoke in opposition to this item. Motion by Ms. Psimas, and seconded by Mr. Heretick, to concur with the recommendation of the Planning Commission that UP-08-15 be approved on first reading, and was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None - Unfinished Business - 08 - 373 - Use permit, comprehensive plan amendment, and rezoning: Motion by Mr. Heretick, and seconded by Ms. Psi mas, to adopt the following resolution approved on first reading at the September 9, 2008 meeting, and was adopted by the following vote: 08-373 (a): "RESOLUTION GRANTING A USE PERMIT (UP-08-09) TO TERRY WEBB TO OPERATE AN ENTERTAINMENT ESTABLISHMENT AT 509 HIGH STREET. WHEREAS, Terry Webb has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit for the operation of an entertainment establishment at 509 High Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or InJurious to the property or improvements in the neighborhood;
