Louise Lucas <br />requests a use permit to operate an adult day support program and <br />residential care facility at 2700 London Boulevard. The <br />Comprehensive Plan's Generalized Future Land Use Map <br />recommends institutional and public uses in the area. Vision <br />Principle: Bold New Directions. <br /> <br />1. Clifford Kalmbach, 3702 Magnolia Drive, spoke in opposition to this item. <br /> <br />Motion by Ms. Psimas, and seconded by Mr. Heretick, to concur with the <br />recommendation of the Planning Commission that UP-08-15 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />08 - 373 - Use permit, comprehensive plan amendment, and rezoning: <br /> <br />Motion by Mr. Heretick, and seconded by Ms. Psi mas, to adopt the following <br />resolution approved on first reading at the September 9, 2008 meeting, and was <br />adopted by the following vote: <br /> <br />08-373 (a): <br /> <br />"RESOLUTION GRANTING A USE PERMIT (UP-08-09) TO TERRY WEBB TO <br />OPERATE AN ENTERTAINMENT ESTABLISHMENT AT 509 HIGH STREET. <br /> <br />WHEREAS, Terry Webb has made application pursuant to Section 40-43.1 of <br />the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit for <br />the operation of an entertainment establishment at 509 High Street, Portsmouth, <br />Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or working in <br />the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or InJurious to the property or <br />improvements in the neighborhood; <br />
