<br />September 23. 2008 <br /> <br />(c) Will be provided with sufficient landscaping to Insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Terry Webb is hereby granted a use permit pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (2006) for the operation of an <br />entertainment establishment at 509 High Street, and being more particularly described <br />as: <br /> <br />UP-08-09 <br /> <br />(509 High Street) <br /> <br />Beginning at a point 79':t from the southwest corner of High and Dinwiddie Streets; <br />thence in a westerly direction 21' :t to a point; thence, in a southerly direction 113.1':t to <br />a point; thence in an easterly direction 21':t to a point; thence, in a northerly direction <br />113.1':t to a point of the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) This establishment shall be limited to a capacity of 150 persons, including <br />employees, or the capacity set by the Fire Marshall. The more restrictive of the two <br />capacity limitations shall apply. The occupancy load shall not be exceeded at any time. <br /> <br />(b) Days and hours of operation shall be daily no earlier than 7:00 a.m. to no later <br />than 2:00 a.m. <br /> <br />(c) Entertainment shall be limited to the hours between 5:00 p.m. and 2:00 a.m. <br /> <br />(d) Noise from the entertainment establishment shall not be audible at the property <br />line. <br /> <br />(e) The facility shall be limited to the use of one D.J. or to a band having no more <br />than five members per day. <br /> <br />(f) Sufficient interior security shall be provided by individuals who are certified in law <br />enforcement by the Virginia Department of Criminal Justice Services. Exterior security <br />shall be provided, as needed, by off-duty law enforcement personnel. <br /> <br />(g) The dance floor may not exceed an area of 150 square feet in size. <br /> <br />(h) The applicant shall obtain approval from the Downtown Design Committee (DDC) <br />for any exterior alterations, including signage. <br /> <br />(i) The applicant shall comply with the trash plan approved by General Services <br />dated October 2007. <br /> <br />(j) The owner/developer shall be responsible for upgrades to water and sewer, as <br />necessary, including the installation of a backflow preventer device approved by the <br />Public Utilities Department. <br />
