September 23. 2008 (c) Will be provided with sufficient landscaping to Insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be In accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Terry Webb is hereby granted a use permit pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (2006) for the operation of an entertainment establishment at 509 High Street, and being more particularly described as: UP-08-09 (509 High Street) Beginning at a point 79':t from the southwest corner of High and Dinwiddie Streets; thence in a westerly direction 21' :t to a point; thence, in a southerly direction 113.1':t to a point; thence in an easterly direction 21':t to a point; thence, in a northerly direction 113.1':t to a point of the beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) This establishment shall be limited to a capacity of 150 persons, including employees, or the capacity set by the Fire Marshall. The more restrictive of the two capacity limitations shall apply. The occupancy load shall not be exceeded at any time. (b) Days and hours of operation shall be daily no earlier than 7:00 a.m. to no later than 2:00 a.m. (c) Entertainment shall be limited to the hours between 5:00 p.m. and 2:00 a.m. (d) Noise from the entertainment establishment shall not be audible at the property line. (e) The facility shall be limited to the use of one D.J. or to a band having no more than five members per day. (f) Sufficient interior security shall be provided by individuals who are certified in law enforcement by the Virginia Department of Criminal Justice Services. Exterior security shall be provided, as needed, by off-duty law enforcement personnel. (g) The dance floor may not exceed an area of 150 square feet in size. (h) The applicant shall obtain approval from the Downtown Design Committee (DDC) for any exterior alterations, including signage. (i) The applicant shall comply with the trash plan approved by General Services dated October 2007. (j) The owner/developer shall be responsible for upgrades to water and sewer, as necessary, including the installation of a backflow preventer device approved by the Public Utilities Department.
