January~ 28, 1992 <br /> <br />237 <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />of said us~ perm~it with conditions. <br /> <br /> NOW, THEREFORE, BE IT REsoLVED by the Council of the <br />Portsmouth, Virginia: <br /> <br />granting <br />City of <br /> <br /> 1. That the use for which the use permit <br />hereinafter-described is sought: <br /> <br />(a) <br /> <br />Will not adversely affect the health and safety <br />of persons resi~ing or working in the <br />neighborhood of the proposed use; <br /> <br />(b) <br /> <br />Will not be detrimental to the public use or <br />injurious to the property or improvements in <br />the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to <br /> insure compatibility with surrounding uses; <br /> <br />(d) <br /> <br />Will be a project that will be developed <br />according to a plan for parking, driveways, <br />curb cuts which will provide for safe and <br />convenient traffic movement; and <br /> <br />and <br /> <br />(a) Will be in accordance with the purposes of the <br /> City of Portsmouth Zoning Ordinance. <br /> <br /> 2. That J. Michael Keating and Michele Bordelon are hereby <br />granted a ~se permit pursuant to Section 40-52.7 (b) of the Code <br />of the City of Portsmouth, Virginia, 1988, for the operation of a <br />bed and breakfast inn on property located at 415 North Street and <br />being more particularly described as: <br /> <br />UP-91-23 <br /> <br /> BEGINNING on the south right-of-way line of <br />North Street at a point 125' + west from its <br />intersection with the west ri~ht-of-way of Court <br />Street; thence south along a side property line <br />115'_+ to a point; thence west 57' ~; thence <br />north 115' + to the south right-of-way line of <br />North StreeT; thence east along said <br />right-of-way 57' ~ to the point of beginning. <br /> <br />3. That this use permit is approved subject to the following <br />conditions: <br /> <br />(a) <br /> <br />The bed and breakfast inn must be operated in <br />accordanc~ with the letter from the applicants <br />to Norman Whitaker, Planning Director, and <br />identified as Exhibit A of the Use Permit <br />application~- <br /> <br />(b) <br /> <br />The applicants shall comply with all <br />applicable codes, ordinances, and regulations <br />of federal, state and local governments, <br />including the "Special Regulations" of <br />Section 40-52.7 (c) of the Zoning Ordinance, <br />and shall obtain all necessary licenses and <br />permits. <br /> <br />(c) <br /> <br />The use permit is issued to J~ Michael Keating <br />and Mi~hele Bordelon and is not transferable <br />~o any other individual, entity, or <br />organization. <br /> <br />Ayes: Clemons~ Corprew, Epperson, King, Hawks, Williams, Webb <br />Nays: None <br /> <br /> <br />
