242 January 28, 1992 The reason for such an action is that arrangements with mortgage companies holding liens on the properties may not be possible prior to bidding and conssructlon. The time is favorable~for bids on such a project, and the prime time of year to beqln construction will soon be upon us. These owners have been forewarned of this possibility, and the fact that it will in no way impe~e, prior arrangements. In the interest of economy, I recommend that adoption of these resolutions to provide the City Attorney with the authority should the need arise." the (A) Motion of Mr. Epperson and seconded by Mr. Clemens, following resolution was adopted and by the following vote: "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY OWNED BY JACQUIE B. MCCREADY UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO THE CHARTER OF THE CITY OF PORTSMOUTH, SAID PROPERTY BEING NECESSARY FOR THE WIDENING IN THE HIGH STREET/SHIRLEY ROAD PROJECT. WHEREASr the Council of the City of Portsmouth has determined it to be in the public interest to widen High in the High Street/Shirley Road Project; and Street WHEREAS, the City has not been able to purchase the property described herein, necessary to the project, because the owner thereof and the City have not been able to agree upon the price to be paid therefor; and WHEREAS, the advancement of the work and the use of said property will be unreasonably delayed if said property is not made available for the project as soon as possible. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: That the' City Attorney be, and he hereby is, directed to institute eminent domain proceedings against the nerelnafter-descrlbe property situate in the City of Portsmouth, Virginia, for the purpose of acquiring the fee simple title thereto pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth, Virginia, as amended, and to deposit to the credit of the Clerk of the Circuit Court of the City of Portsmouth, as provided by law, the sum hereinafter specified to compensate the owner of the property designated and shown as "Plat Showing Parcel owned by Jacquie B. McCready to be acquired by City of Portsmouth, Virginia," made by Hassell & Folkes, P.C., Engineers, Surveyors & Planners, dated March 31, 1989, a copy of which plat is attached hereto and made a part hereof. The name of the property owner'is Jacquie B. McCready. The amount to be deposited to the credit of the Clerk of the Circuit Court of the City of Portsmouth'is $300.00."
