The time is <br />favorable~for bids on such a project, and the prime time of <br />year to beqln construction will soon be upon us. These owners <br />have been forewarned of this possibility, and the fact that it <br />will in no way impe~e, prior arrangements. <br /> <br /> In the interest of economy, I recommend that adoption of <br />these resolutions to provide the City Attorney with the <br />authority should the need arise." <br /> <br />the <br /> <br />(A) Motion of Mr. Epperson and seconded by Mr. Clemens, <br />following resolution was adopted and by the following vote: <br /> <br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN <br /> PROPERTY OWNED BY JACQUIE B. MCCREADY UNDER EMINENT DOMAIN <br /> PROCEEDINGS PURSUANT TO THE CHARTER OF THE CITY OF <br /> PORTSMOUTH, SAID PROPERTY BEING NECESSARY FOR THE WIDENING <br /> IN THE HIGH STREET/SHIRLEY ROAD PROJECT. <br /> <br /> WHEREASr the Council of the City of Portsmouth has <br />determined it to be in the public interest to widen High <br />in the High Street/Shirley Road Project; and <br /> <br />Street <br /> <br /> WHEREAS, the City has not been able to purchase the <br />property described herein, necessary to the project, because <br />the owner thereof and the City have not been able to agree upon <br />the price to be paid therefor; and <br /> <br /> WHEREAS, the advancement of the work and the use of said <br />property will be unreasonably delayed if said property is not <br />made available for the project as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> That the' City Attorney be, and he hereby is, directed to <br />institute eminent domain proceedings against the <br />nerelnafter-descrlbe property situate in the City of <br />Portsmouth, Virginia, for the purpose of acquiring the fee <br />simple title thereto pursuant to Sections 2.06, 2.07 and 2.08 <br />of the Charter of the City of Portsmouth, Virginia, as amended, <br />and to deposit to the credit of the Clerk of the Circuit Court <br />of the City of Portsmouth, as provided by law, the sum <br />hereinafter specified to compensate the owner of the property <br />designated and shown as "Plat Showing Parcel owned by Jacquie <br />B. McCready to be acquired by City of Portsmouth, Virginia," <br />made by Hassell & Folkes, P.C., Engineers, Surveyors & <br />Planners, dated March 31, 1989, a copy of which plat is <br />attached hereto and made a part hereof. <br /> <br /> The name of the property owner'is Jacquie B. McCready. <br /> <br /> The amount to be deposited to the credit of the Clerk of <br />the Circuit Court of the City of Portsmouth'is $300.00." <br /> <br />Ayes: Clemons, Corprew, Epperson, King.
