243 <br /> <br />~'~m~ESeL~gtON TOPROVIDEFeR ~HE'AC~SiT~ON~ OF <br />PRGPERT~'~W~ED ~y LO~S'~. ~YEPiS:~,~t.J:~E~. <br />EMINENT DOMAIN PROCEEDINGS PURS~A~TTOT~E CHARTER OF THE <br />CITY OF PORTSMOUTH, SAID PROPERTY BEING NECESSARY FOR THE <br />WIDENING IN THE HIGH STREET/SHIRLEY ROAD PROJECT. <br /> <br /> WHEREAS, the Council of the City of Portsmouth has determined <br />it to be in the public interest to widen High Street in the High <br />Street/Shirley Road Project; and <br /> <br /> WHEREAS, the City has not been able to purchase the property <br />described herein, necessary to the project, because owners ther~ <br />and the City have not been ~ble to agree upon the price to be paid <br />therefor; and <br /> <br /> WHEREAS, the advancement of the work and the use of said <br />property will be unreasonably delayed if said property is not made <br />available for the pro3ect as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> That the City Attorney be, and he hereby is, directed to <br />institute eminent domain proceedings against the <br />hereinafter-described property situate in the City of Portsmouth, <br />Virgznia, for the purpose of acquiring the fee simple title <br />there~o pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of <br />the City of Portsmouth, Virginia, as amended, and to deposit to <br />the credit of the Clerk of the Circuit Court of the City of <br />Portsmouth, as provided by law; the sum hereinafter specified to <br />compensate the owners of the property designated and shown as <br />"Plat Showing Property To Be Acquired From Louis N. Myers and <br />Alice W. Myers For Right-of-way Purposes," made by Engineering <br />Services,' Inc., Civil Engineering-Land Surveying, dated July 17, <br />1991, a copy of which plat is attached hereto and made a part <br />hereof. <br /> <br /> The name of the property owners are Louis N. Myers and Alice <br />W. Myers. <br /> <br /> The amount to be deposited to the credit of the Clerk of the <br />Circuit Court of the City of Portsmouth is $1,700.00." <br /> <br />Ayes: Clemons, Corprew, Epperson, King, Hawks, Williams, Webb <br />Nays: None <br /> <br /> (c) Motion of Mr. Williams and seconded by Mr. Epperson, the <br />following resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN <br />PROPERTY OWNED BY WILHEMINA H. CARSON UNDER EMINENT DOMAIN <br />PROCEEDINGS PURSUANT TO THE CHARTER OF THE CITY OF <br />PORTSMOUTH, SAID PROPERTY BEING NECESSARY FOR THE WIDENING <br />THE HIGH STREET/SHIRLEY ROAD PROJECT. <br /> <br /> WHEREAS, the Council of the City of Portsmouth has determined <br />it to be in the public interest to widen High Street in the High <br />Street/Shirley Road Project; and <br /> <br /> WHEREAS, the City has not been able to purchase the property <br />described herein, necessary to the project, because the owner <br />thereof and the City have not been able to agree upon the price tc <br />be paid therefor; and <br /> <br /> <br />
