239 <br /> <br /> January 28, 1992 <br /> <br /> Asbestos removal efforts in.the library have encountered <br />additional asbestos which must be removed during this ~project. In <br />addition, the renovation planned for the Elm Avenue Neighborhood <br />Facility under the UPAR Grant, has encountered further unexpected <br />asbestos in the form of floor tiles which must be removed from <br />this facility to allow the overall renovation to proceed. The <br />change orders for these two work items will result in additions to <br />the contract exceeding the 25% allowable under our purchasing <br />ordinances. <br /> <br /> Because work is in progress on the library, as weil as the <br />the Neighborhood Facility, your approval is requested to exceed <br />the 25% change order limitation. It is anticipated that the total <br />change orders will not exceed $60,000, of which $10,000 is <br />currently available from prior appropriations, or approximately <br />36% of the contract. To cover the cost for these changes, as well <br />as for increased monitoring costs, an appropriation of $'50,000 <br />from the funds allocated in the approved FY 1991-92 CIP for <br />asbestos abatement is requested. The Director of General <br />Operations recommends approval of the increase to Nash <br />Construction, as well as appropriation of the additional $50,000. <br /> <br /> I concur with the recommendations and, therefore, request <br />your approval to exceed the 25% change order limit for the <br />asbestos removal contract with Nash Construction and appropriation <br />of the additional $50,000. I am requesting your approval of these <br />items on first reading as the contractor is presently on site <br />performing the previously authorized work. <br /> <br /> With your approval of this item, the balance available in the <br />Capital Improvements Fund is $13,175,070." <br /> <br />(A) Motion of Mr. Clemons and seconded by Mr. Epperson, the <br />following ordinance was adopted on first reading, and by the <br />following vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $50,000.00 FROM THE CAPITAL <br />IMPROVEMENTS FUND FOR THE REMOVAL OF ASBESTOS FROM THE <br />CITY OWNED ELM AVENUE NEIGHBORHOOD FACILITY AND THE MAIN <br />LIBRARY." <br /> <br />Ayes: Clemons, Corprew, Epperson, King, Hawks, Williams, Webb <br />Nays: None <br /> <br />(B) Motion of Mr. King and seconded by Mr. Epperson to authorize <br />the City Manager to execute an amended contract and to exceed the <br />change order limit as requested and was adopted by the following <br />vote: <br /> <br />Ayes: Clemons, Corprew, Epperson, King, Hawks, Williams, Webb <br />Nays: None <br /> <br /> 92-31 - Letter from the City Manager recommending adoption of <br />an ordinance to amend Chapter 14 of the City Code of Portsmouth, <br />Virginia, 1988, by amending Sections 14-5(j), 14-6[a), 14-10, and <br />14-13(a)(1) pertaining to the Floodplains. <br /> <br /> "Acting on advice of the Virginia Division of Soil and Water <br />Conservation, the City of Portsmouth recently adopted a new <br />Floodplain Ordinance. The ordinance was reviewed and approved by <br />the State prior to final adoption. Subsequent review by the <br />Federal ~mergency Management Agency (FEMA) revealed that minor <br />revisions were needed before the ordinance would be in full <br />compliance with federal regulations. The changes recommended by <br />staff are those required for full compliance with FE~A's <br />requirements. <br /> <br /> <br />
