February 26. 2008

WHEREAS, the Chief of the Portsmouth Department of Fire, Rescue and
Emergency Services (the "Fire Chief") has determined that Southern has appropriate
trained staff and equipment to properly provide said services; now therefore

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Portsmouth, Virginia:

1. Said local government approval is hereby granted to Southern, with the
following mandatory requirements while operating within the City of Portsmouth:

a. Southern shall limit its transport services to non-emergency transports.

b. Southern may not attempt to provide service to, nor shall it respond to,
emergency situations (commonly known as "911 Calls") unless requested by an
authorized official of the Portsmouth Department of Fire, Rescue, and Emergency
Services (the "Department"), or through a written agreement with the Department.

c. If Southern learns of an emergency situation while engaged in the normal course
of business, it shall promptly report same to the Dispatch Center operated by the
Department, and it shall thereafter follow all directives of the Department.

d. By accepting this approval, Southern acknowledges and agrees that the
Department is the only designated 911 agency authorized to provide emergency
services and emergency transport.

e. Southern shall timely pay all federal, state, and local taxes, shall obey all
applicable federal, state, and local laws and regulations, and shall keep all its transport
vehicles and medical equipment in a safe, neat, clean, well-maintained, and sanitary
condition.

2. The Fire Chief is hereby authorized by City Council to enforce the terms of
this resolution. If the Fire Chief determines that there has been a material violation of
any provision hereof, or any other conduct that places public safety or the public interest
at risk, he shall report it to the Virginia Office of Emergency Medical Services and shall
thereafter cooperate with said Office in any investigation.

3. This resolution shall take effect on the date of its adoption."

Ayes: Heretick, Psi mas, D. Smith, R. Smith, Randall
Nays: None

08 - 110 - Adoption of a resolution designating the Chief Financial Officer as the City's
"Authorized Agent" to provide information for certain Federal Department of Homeland
Security programs administered by the Commonwealth of Virginia. Vision Principle:
Thriving Neighborhoods and a Sense of Community.

Background:
. Both State and Federal laws require that "public entities" authorize an agent to
provide all information as may be needed for federal grant programs under the federal
Department of Homeland Security, as administered by the Commonwealth of Virginia.
. Some of the grant programs that provide funds directly to our local jurisdiction
include the Citizen Corps Program, Local Emergency Management Performance Grant,
the State Homeland Security Program and the Assistance to Firefighters Program.
Other federal grant programs provide funding through the Hampton Roads Planning
District Commission or other regional entities.
