Upon adoption, the ordinance will become effective immediately for purposes of <br />enforcing the Rental Inspection Code. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND SECTION 17-83 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) PERTAINING TO VIOLATIONS OF THE RENTAL <br />INSPECTIONS CODE." <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />08 - 76 - Adoption of an ordinance to amend Chapters 17 and 23 of the Code of the City <br />of Portsmouth, Virginia (2006) by amending Section 17-23 pertaining to the Building and <br />Structures Maintenance Code and Section 23-1 pertaining to Nuisances. Vision <br />Principle: Thriving Neighborhood and a Sense of Community. <br /> <br />Background: <br />. Prior to the re-codification of the City Code in 2006, the definition of "debris" was <br />stated as the "open outdoor storage of personal property of any kind such as appliances <br />or appliance parts, furniture, interior or exterior equipment or machinery, which is no <br />longer used, including antiques, collectables, glassware and crockery". <br />. This language was omitted during the re-codification of the City Code in 2006. <br /> <br />Discussion: <br />. The definition should be revised and amended to include "open outdoor storage <br />of personal property of any kind such as appliances or appliance parts, furniture, interior <br />or exterior equipment or machinery, which is no longer used, including antiques, <br />collectables, glassware and crockery" as set forth in the proposed Ordinance Section <br />17-23 of the Building and Structures Maintenance Code, which sets out definitions of <br />the Building and Structures Maintenance Code. <br />. Additionally, Section 23-1, which sets forth definitions for the Nuisances Code, <br />should also be amended to provide that "open outdoor storage of personal property of <br />any kind such as appliances or appliance parts, furniture, interior or exterior equipment <br />or machinery, which is no longer used, including antiques, collectables, glassware and <br />crockery" shall constitute "debris". <br /> <br />Financial Impact: <br />. There is no financial impact on the city. <br /> <br />Staff Recommends: <br />. Adoption of ordinance.
