291 <br /> <br />March ~24, 1992 <br /> <br />92-86 (c)- UP-92-02 Mo~ion of Mr. Hawks and seconded by Mr. King, <br /> the following resolution was adopted and by <br /> the following vote: ~ <br /> <br /> ~"A REsoLUTION GRANTING A USE PERMIT TO VIRGINIA IRON AND <br /> METAL RECYCLING, INC.f TO OPERATE A RECYCLING PLANT AT 500' <br /> CONFEDERATE AVENUE. <br /> <br /> WHEREAS, Virginia Iron and Metal Recycling, Inc., has made <br />application pursuant to Section 40-43.1 of the Code of the City of <br />Portsmouthf Virginia, 1988, for granting of a use permit to <br />operate a recycling plant at 500 Confederate Avenue, Portsmouth, <br />Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />applica%ion; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting <br />of said use permit, with conditions. <br /> <br /> NOW, THEREFORE, BE IT REsoLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit hereinafter described <br />is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons <br />residing Or. working in the neighborhood ~f..the' prop0$ed use; <br /> <br />(b) Will no~ be detrimental to the public use or injurious to the <br />propertyor improvements in the neighborhood; <br /> <br />(c) .WilI be provided with sufficient landscaping to insure <br />compatibility with surrounding uses; <br /> <br />(d) Will be a project that will be developed aCcOrding to a plan <br />for parking, driveways, and curb cuts which will provide for safe <br />and convenient traffic movement; and <br /> <br />(e) Will be in accordance with the purposes of the City of <br />Portsmouth Zoning Ordinance. <br /> <br />2. That Virginia Iron and Metal Recycling, Inc. is hereby <br />granted a[use permit pursuant to Section 40-43.1 of the Code of <br />th~~ City of Portsmouth, Virginia, 1988, to operate a recycling <br />plant a~ 500 Confederate Avenue,.said property being more <br />particularly described as follows: <br /> <br />UP-92-2 <br /> <br />Beginning at the southwest intersection of High Street and <br />Confederate Avenue; thence sou~h 485' along the west right-of-way <br />of Confederate Avenue to the north right-of-way line of County <br />Street; thence west a~ong said right-of-way 235'~ to a point; <br />thence southwest 60' tO the eas~tern property line ~f the Norfolk & <br />Portsmout-h Belt Line Railroad; thence north along said property <br />line 540' ~o the south rightLof-way line of High Street; thence <br />east along Said right-of-way 265' to Confederate Avenuei,~ the point <br />of beginning. <br /> <br />3.
