<br /> WHERE~S,~%he plans fOr the reconstruct~ion of Churchland
<br />Boulevard, VDOT ~rojeet U000-124-105, PE1Ot,<RW201, C501;~have
<br />been completed to the point that the limits of the proposed
<br />right~o'f~way can b~ identified; and ~
<br />
<br /> WHEREAS, construction of this project will require the
<br />acquisition of property located at 5965 Churchland Boulevard,
<br />Portsmouth, Virginia, which VDOT advises is owned by R. S.
<br />Black, Sr.; and
<br />
<br /> WHEREAS, VDOT haS determined that early~acquisitiOn of
<br />this property is warranted due to the fina~n¢ial hardship being
<br />experienced by the owner; and
<br />
<br /> WHEREAS, VDOT requires that the City concur with the
<br />purchase of~ th~ ~igh%~'of-way for this pr~jec~ and authOrize the
<br />expendi't~re'of %n appropriate sum representing its share of the
<br />costs. ~ ~

<br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the
<br />City of Portsmouth, Virginia, hereby requests the Virginia
<br />Department of Transportation to 'proceed with the early
<br />acquisition of the parcel of property located at 5965
<br />Churchland~B'oulevard, Portsmouth,~ Virgin'ia, which VDOT advises
<br />is owned bY R~' S~ Black, Sr,, at an estimated Cost of
<br />$205,U80~00, ahd~hat~pursuant to Section 33%t-44 of ~he Code.
<br />of Virginia, 1950~ as amended, the City of Portsmouth does
<br />hereby agree to pay two percent (2%) of the right-of-way
<br />acquisition~eosts of the property which VDOT advises is owned
<br />by R. S. Black, Sr., in an amount not to exceed $4,100.00.

<br /> That this resolution shall take effect on the date of its
<br />adoption."
