December 12, 2000 <br /> <br />- City Manager's Report - <br /> <br />00 - 311 - Adoption of an ordinance to amend Article VII, Chapter 35, Section 35-320 of <br />the Code of the City of Portsmouth regarding Utility Services Tax <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend Chapter 35, Section 35-320 of the Code of the <br />City of Portsmouth regarding Utility Services Tax. <br /> <br />Purpose and Need: <br /> <br />· At the October 10, 2000 City Council meeting, the Council approved code changes <br />related to the conversion of utility taxes from a tax based on the amount of the bill to <br />one that is based on the amount of energy consumed. This code change was <br />necessary based on actions of the Virginia General Assembly. <br /> <br />· This revision will more clearly define the residential consumer to include the wording <br />"individually metered by residential unit" for the correct rate to be charged to apartment <br />houses and other multiple-family dwellings. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact for this item. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Benn, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 35 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA {1988) BY AMENDING SECTION 35-320 THEREOF <br />PERTAINING TO THE DEFINITION OF "RESIDENTIAL CONSUMER" FOR <br />PURPOSES OF THE UTILITY SERVICES TAX." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />00 - 312 -Adoption of a resolution authorizing the City Manager to abandon existing <br />storm drainage easements as required on the Tower Mall site. <br /> <br />Recommendation: <br /> <br />· Approval of a resolution authorizing the City Manager to abandon existing storm <br />drainage easements as required on the Tower Mall site. <br /> <br />Purpose and Need: <br /> <br />· In order to provide for the future development of this site it is required that the <br />existing storm drainage be removed and relocated on the site. <br /> <br />· The existing easements must be abandoned to allow for the location of new <br />facilities. <br /> <br />Financial Impact: <br /> <br />· The abandonment of the drainage easements will have no financial impact. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED <br />RELEASING AND VACATING STORM DRAINAGE EASEMENTS ON THE SITE OF <br />TOWER MALL. <br /> <br /> <br />
