<br />September 11. 2007 <br /> <br />07 -345 (f): <br /> <br />"ORDINANCE TO AMEND CHAPTERS 35 AND 40 AND APPENDIX A OF THE <br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY AMENDING <br />SECTIONS 35-190, 40-22, 40-61.1, 40-71.1(a), 40-196, AND APPENDIX A AND BY <br />REPEALING SECTIONS 40-51 THROUGH 40-54, 40-171.2, AND 40-178 THEREOF <br />PERTAINING TO THE CITY'S HISTORIC DISTRICTS." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />07 - 388 - Adoption of a resolution authorizing the City Manager to execute a Right of <br />Way Permit and Easement to Virginia Electric and Power Company at Scotts Creek <br />Park. Vision Principle: Thriving Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. Scotts Creek Park is currently under construction along the north side of London <br />Boulevard between Scotts Creek and Constitution Avenue. The park is located on City <br />owned property. <br />. As part of the park design, lighting is desired in the central portion of the park <br />near the intersection of North Street and Jamestown Road. Ten pole mounted <br />decorative lighting fixtures with underground wiring are proposed to be installed. <br /> <br />Discussion: <br />. Dominion Virginia Power will install and maintain lighting as part of our street light <br />program. <br />. Dominion Virginia Power requires an easement allowing them to enter the <br />property to construct and maintain the lighting fixtures and power lines, and to operate <br />the lights. <br /> <br />Financial Impact: <br />. The discounted installation cost to the City of Portsmouth will be $883.37, which <br />will be paid out of the project funding code. The City of Portsmouth receives a credit <br />equal to six years of projected revenue against the cost of installation. <br /> <br />Staff Recommends: <br />Adoption of proposed resolution. Vision Principle: Thriving Neighborhoods and a Sense <br />of Community. <br /> <br />Next Steps following City Council Action: <br />. The City Manager will execute the License and Permit Agreement and any other <br />necessary documents to convey to Dominion Virginia Power rights to install and <br />maintain street light fixtures. <br /> <br />Motion by Mr. Heretick, and seconded by Ms. Randall, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A RIGHT OF <br />WAY PERMIT AND EASEMENT TO VIRGINIA ELECTRIC AND POWER COMPANY <br />AT SCOTT'S CREEK PARK. <br /> <br />BE IT RESOLVED that the City Manager be and he hereby is authorized to <br />execute a right of way permit agreement with Virginia Electric and Power Company to <br />provide Virginia Electric and Power Company with necessary right of entry to construct <br />electric lighting at Scott's Creek Park, and <br />
