<br />September 11. 2007 <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Portsmouth SB, L. L. C., is hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (2006) for the operation <br />of an eating establishment at 361 Effingham Street, and being more particularly <br />described as: <br /> <br />UP-07-18 <br /> <br />That parcel beginning at a property pin located at the northwest corner of the property at <br />the corner of Effingham Street and North Street. Thence, proceeding N 8r03'48"E, <br />271.64 feet more or less to a point thence, proceeding S 03041 '12"E 113.55 feet more <br />or less to a point, thence proceeding S 8rOO'18"W 150.02 feet more or less to a point, <br />thence proceeding S 02056'52"E 16.18 feet more or less to a point, thence proceeding <br />S 8rOO'18"W 121.69 feet more or less to a point, thence proceeding N 03033'42"W <br />more or less to a point of beginning. Said property is also known as Tax Map 20, Parcel <br />18 and 361 Effingham Street. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) The establishment shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments. <br /> <br />(b) The applicant shall obtain all required licenses and permits before operation, and <br />these licenses and permits shall remain in effect during the operation of the <br />establ ishment. <br /> <br />(c) The applicant shall obtain a Subdivision Permit from the City before construction <br />can begin. <br /> <br />(d) The applicant shall construct the development in accordance with the submitted <br />plans dated June 21, 2007 and submitted elevations submitted June 22, 2007. The <br />Director of Planning and Zoning may approve minor modifications. <br /> <br />(e) The hours of operation shall be limited to the hours between 5:00 a.m. and 2:00 <br />a.m. every day. <br /> <br />(f) The occupant load shall be limited to 54 people, including employees, and <br />seating shall be limited to 49 people. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D.
