September 11. 2007 Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None (c) Z-07 -12 WEST GROVE/MAPLE SHADE - Mr. Joseph Vinson requests the rezoning of 3117 and 3121 Turnpike Road from residential multi- family, RM-60, to office residential, OR-75, in order to utilize the existing single family home for a real estate brokerage office. Vision Principle: A Robust and Prospering Economy. There were no speakers. Motion by Mr. D. Smith, and seconded by Ms. Randall, to concur with the recommendation of the Planning Commission that Z-07-12 be approved on first reading, and was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None - Unfinished Business - 07 - 366 - Use permit: '" Mr. D. Smith disclosed that his brother is involved in the development of this project Motion by Mr. Heretick, and seconded by Mr. R. Smith, to adopt the following resolution approved on first reading at the August 28, 2007 meeting, and was adopted by the following vote: 07-366 (a): "RESOLUTION GRANTING A USE PERMIT (UP- 07-18) TO PORTSMOUTH SB, L.L.C., TO OPERATE AN EATING ESTABLISHMENT AT 361 EFFINGHAM STREET. WHEREAS, Portsmouth SB, L.L.C., has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit to operate an eating establishment at 361 Effingham Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or InJurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to Insure compatibility with surrounding uses;
