<br />September 11. 2007 <br /> <br />At a Regular Meeting of the City Council on Tuesday, September 11, 2007, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Marlene W. Randall, William E. Moody, Jr., <br />Stephen E. Heretick, Elizabeth M. Psi mas, Ray A. Smith, Sr., Douglas L. Smith, City <br />Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />Vice Mayor Marlene W. Randall opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Moody, to approve the minutes of a <br />Called Meeting on August 28, 2007, and of a Regular Meeting on August 28, 2007, and <br />was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />- Public Hearing - <br /> <br />07 - 387 - Use permit and rezoning applications: <br /> <br />(a) UP-07-09 <br /> <br />BRIGHTON NEIGHBORHOOD - Sarah Grant requests a use <br />permit to operate a nursing and personal care facility at 1535 <br />Marshall Avenue. The property is currently zoned residential <br />single-family, RS-60. Vision Principle: Thriving Neighborhoods and <br />a Sense of Community. <br /> <br />1. Robert Barclay, 200 High Street, Suite 500, spoke in support of this item. <br /> <br />2. Marvin Grant, 1535 Marshall Avenue, spoke in support of this item. <br /> <br />Motion by Mr. Moody, and seconded by Mr. R. Smith, to concur with the <br />recommendation of the Planning Commission that UP-07 -09 be approved on first <br />reading. <br /> <br />Motion by Ms. Psimas, and seconded by Mr. D. Smith, to amend to the motion to <br />accept this proposal with a recommendation of two rather than five parking spaces, and <br />was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />Motion by Mr. Moody, and seconded by Mr. R. Smith, to concur with the <br />recommendation of the Planning Commission that UP-07 -09, with the amended number <br />of parking spaces, be approved on first reading, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />(b) Z-07-11 <br /> <br />DOWNTOWN CORRIDOR - Ollie C. Wilkins requests the rezoning <br />of 620 Constitution Avenue from Downtown, D-2, Industrial to <br />Downtown, D-2, office to expand Bethel Temple Church. Vision <br />Principle: Thriving Neighborhoods and a Sense of Community. <br /> <br />1. Earl Hinton, Sr., 2106 County Street, spoke in support of this item. <br /> <br />Motion by Ms. Psimas, and seconded by Mr. Heretick, to concur with the <br />recommendation of the Planning Commission that Z-07-11 be approved on first reading, <br />and was adopted by the following vote: <br />
