<br />July 10. 2007 <br /> <br />Background: <br />. Precinct 37, located at Churchland Middle School, currently has 6,073 registered <br />voters. <br />. This precinct needs to be divided so that it can better accommodate the voters. <br />. The Portsmouth Electoral Board recommends the creation of a new precinct to <br />alleviate long lines and to make the voting process more efficient. <br /> <br />Discussion: <br />. River Shore Baptist Church, located at 4051 River Shore Road, has agreed to <br />serve as a precinct beginning November 6,2007. <br />. The church is located less than a mile from Churchland Middle School, is <br />handicapped accessible, and has plenty of parking spaces. <br /> <br />Financial Impact: <br />. There is no financial impact on the City of Portsmouth. <br /> <br />Staff Recommends: <br />Adoption of a proposed ordinance. Vision Principle: Thriving Neighborhoods and a <br />Sense of Community <br /> <br />Next Steps Following Council Action: <br />. Pending approval, the General Registrar will request the Department of Justice's <br />approval and will then notify voters of their new precinct. <br /> <br />Motion by Mr. Heretick, and seconded by Mr. R. Smith, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTER 10 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 10-69 THEREOF AND <br />BY ADOPTING NEW SECTIONS 10-72 AND 10-122 PERTAINING TO THE <br />MODIFICATION OF VOTING PRECINCT NO. 37 AND THE CREATION OF NEW <br />VOTING PRECINCT NO. 39." <br /> <br />Ayes: Heretick, Psi mas, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />07 - 316 - Adoption of a resolution authorizing the City Manager to execute a deed of <br />release for a 20 foot public utility easement over, under and across the old Lowe's site <br />north of Western Branch Boulevard in the Churchland area. Vision Principle: A Robust <br />and Thriving Economy and Thriving Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. On April 30, 1965 the then owners of this property granted the City of Portsmouth <br />a 20 foot wide Utility (water main) easement across this property for the purpose of <br />laying a water main from US Route 17 to the Armistead Forest Subdivision. When the <br />Lowes was built the developer relocated the water main to a new easement dedicated <br />at the edge of the site and the original water main was abandoned. However, there is no <br />record of the original easement being vacated after the relocation of the water main. <br /> <br />Discussion: <br />. The Portsmouth Department of Public Utilities has declared the original <br />easement surplus, having no plans for its proposed future utilization. <br />. As this easement bisects the site and would run beneath a building (new car <br />dealership) proposed for this site, the contracted purchaser of this site, Klimkiewicz <br />Family Western Branch, LLC has requested that the easement be vacated. <br /> <br />Financial Impact: <br />. There is no cost to the City for the release of this easement. However, it would <br />facilitate economic growth by allowing full redevelopment of the former Lowes site. <br />
