Vision Principles: A Robust and Prospering Economy <br />and Thriving Neighborhoods and a Sense of Community. <br /> <br />Next Steps following City Council Action: <br />. The City Manager will execute the Deed of Release and any other required <br />documents on behalf of the City to complete the release of this portion of the easement. <br />. The Office of the City Attorney will see to the preparation of appropriate <br />documents to be presented to the City Manager for his execution releasing this <br />reserved portion of the easement. <br /> <br />Motion by Mr. R. Smith, and seconded by Mr. Heretick, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF <br />RELEASE FOR A 20 FOOT PUBLIC UTILITY EASEMENT OVER, UNDER AND <br />ACROSS THE OLD LOWE'S SITE NORTH OF WESTERN BRANCH BOULEVARD IN <br />THECHURCHLANDAREA. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth that the City <br />Manager be, and he hereby is, authorized to execute a Deed of Release and any other <br />documents as may be required to the owner(s) of Parcel A1A1 as shown on that certain <br />plat entitled: "RE-SUBDIVISION OF PARCEL A1A OF RESUBDIVISION PLAT OF <br />PARCELS A1 & A2 (M.B. 146, P.53) & UNNAMED PARCEL AS SHOWN ON PLAT <br />LAUREL PARK (D.B. 614, P. 267) dated March 24, 2006 and duly recorded in the <br />Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia in Map Book 21, <br />Page 89, and designated as "EX. 20' UTILITIES ESM'T TO BE ABANDONED (M.B. 77, <br />P. 98-98C)", releasing to such owner(s) all right, title and interest, if any, which the City <br />of Portsmouth has, or may have, in and to said easement for construction, <br />maintenance, operation and replacement of public utility lines 20 feet in width from the <br />City boundary line between the City of Chesapeake and the City of Portsmouth <br />northwardly to a point 20 feet south of the northern boundary of said parcel as shown on <br />the aforementioned plat." <br /> <br />Ayes: Heretick, Psi mas, D. John Berry, 538 Mount Vernon Avenue, spoke on the issue of temporary signage in <br />the City. <br />
