<br />June 12. 2007 <br /> <br />(c) UP-07 -10 <br /> <br />MOUNT HERMON - Michael Carr requests a use permit to operate <br />a restaurant at 3112 High Street. Vision Principle: A Robust and <br />Prospering Economy. <br /> <br />1. Michael Carr, 905 Martindale Lane, Virginia Beach, spoke in support of this item. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. R. Smith, to concur with the <br />recommendation of the Planning Commission that UP-07-10 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Moody, Psimas, Randall, R. Smith, D. Smith, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />07 - 263 - Adoption of an ordinance to amend Chapter 22 of the Code of the City of <br />Portsmouth, Virginia (2006) by amending Sections 22-562(a)(11), 22-576(b), 22-578(a), <br />22-611 (b), 22-642(b), and 22-664 thereof pertaining to the issuance of parking tickets. <br />Vision Principle: Thriving Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. The City proposes to use uniformed City and Parking Authority employees not <br />employed by the Police Department and appointees to enforce the parking provisions of <br />the City Code. <br />. The current City Code only allows police officers and police department <br />employees to enforce most provisions. <br />. The City staff has also recommended clarifying that the December parking fine <br />reductions in the Downtown Business district apply only to overtime parking and expired <br />meter violations. <br /> <br />Discussion: <br />. The City Attorney's Office has drafted proposed code amendments that will allow <br />uniformed City and Parking Authority employees not assigned to the Police Department <br />and other appointees to enforce the parking code provisions. <br />. In addition, the questions that have arisen since December about the coverage of <br />the code amendment reducing fines from $25 to $15 will be answered by clearly <br />providing that the reduced fines only apply to overtime parking and expired meter <br />violations. <br /> <br />Financial Impact: <br />. Enhanced enforcement should result in greater use of city garages and parking <br />meters, as well as increased fine collections. <br /> <br />Staff Recommends: <br />Adoption of proposed ordinance. Vision Principle: Thriving Neighborhoods and a <br />Sense of Community. <br /> <br />Next Steps Following Council Action: <br />. The non-police employees who have been undergoing training will begin <br />enforcing the City's parking code provisions. <br /> <br />1.
