<br />June 12. 2007 <br /> <br />Background: <br />. At the behest of the US Environmental Protection Agency (EPA) and the Virginia <br />Department of Environmental Quality (DEQ), Portsmouth, HRSD and 13 other Hampton <br />Roads jurisdictions (Localities) have developed a comprehensive & cooperative <br />program to abate sanitary sewer over flows (SSO's) throughout the region. <br />. This work, done under the aegis of the Hampton Roads Planning District <br />Commission (HRPDC), consists of interrelated regional and individual locality efforts <br />and was developed in a relatively short period of time with close consultation with DEQ. <br />. The Regional Consent Order Package (Regional Package), detailing the regional <br />and individual localities commitments, consists of three interrelated documents: a <br />Special Order by Consent issued by DEQ to HRSD and the Localities, a Regional <br />Technical Standards guide, and a Memorandum of Agreement (MOA). <br /> <br />Discussion: <br />. In order to keep the regional SSO compliance effort on track and to demonstrate <br />continued "good faith" to DEQ and EPA, the Localities have collectively agreed to seek <br />approval of the Regional Package from their governing bodies and authorize their Chief <br />Executive officers to execute the Regional Package in June of 2007. <br />. DEQ will then advertise the Regional Package for public comment and submit it <br />for approval by the State Water Control Board. <br />. If the Regional Package is significantly modified by DEQ or the Board it will be <br />brought back to City Council for further consideration. <br /> <br />Financial Impact: <br />. The Sanitary Sewer System Evaluation Plan is expected to cost approximately <br />$0.9 million, which is included in the Public Utilities Capital Improvements Budget. <br />Future financial impacts to the City's Public Utilities Enterprise Fund may be substantial <br />the scope and amount of which will be assessed and reported as part of the Plan. <br /> <br />Staff Recommends: <br />Adoption of the proposed resolution. Vision Principle: Thriving Neighborhoods <br />and a Sense of Community. <br /> <br />Next Steps Following Council Action: <br />. Pending approval, the City Manager will execute the Regional Package on behalf <br />of Portsmouth and forward it to DEQ as part of the regional localities submission. <br /> <br />Motion by Mr. D. Smith, and seconded by Mr. R. Smith, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION APPROVING A REGIONAL SANITARY SEWER PACKAGE AND <br />AUTHORIZING THE CITY MANAGER TO EXECUTE A REGIONAL CONSENT <br />ORDER AND MEMORANDUM OF AGREEMENT TO ASSURE CITY PARTICIPATION <br />AND COOPERATION IN FULFILLING THE OBLIGATIONS CONTAINED THEREIN. <br /> <br />WHEREAS, the Hampton Roads Sanitation District ("HRSD") provides sewage <br />treatment service to the cities of Chesapeake, Hampton, Newport News, Poquoson, <br />Portsmouth, Suffolk, Virginia Beach, and Williamsburg; the counties of Gloucester, Isle <br />of Wight, and York; the James City Service Authority; and the town of Smithfield. <br />(collectively, the "Localities"); and <br /> <br />WHEREAS, the City of Portsmouth and other Localities individually own and <br />operate sanitary sewer collection systems, which collect sewage within their individual <br />jurisdictional boundaries that is delivered to the HRSD system for treatment; and <br /> <br />WHEREAS, due to pipe breaks, electrical outages, wet weather events, <br />insufficient capacity in the collection, interceptor and treatment systems, and other <br />factors, untreated sewage is, on occasion, discharged from various locations in the <br />HRSD sewer system and from the Localities' sanitary sewer systems; and <br />
