October 27, 1992 <br /> <br /> "The legislature of Virginia has provided that the penalty <br />for violation of the Uniform Statewide Building Code provisions <br />with respect to lead-based paint be changed from a fine of <br />Sl,000 per~ C'h~r~-~o a fine of $2,500 per charge. ~This change <br />in the Code provides for the exa~ting of a larger fine in those <br />instances where p~egn~nt women or childre~ under the age of six <br />years old may be affected. <br /> <br /> As you are-aware, lead-based paint represents a potential <br />threat to young children, and I ~ecommend the adoption of this <br />ordinance." <br /> <br /> On motion of Mr. King and <br />following was adopted on first <br />following vote: <br /> <br />seconded by Mr. Pitts, the <br />and final reading, and by the <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 17 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION <br />17-26(c) THEREOF, PERTAINING TO VIOLATIONS AND PROCEDURES <br />FOR ABATEMENT FOR NUISANCES". <br /> <br />Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts,-Webb <br />Nays: None <br /> <br /> 92-364 - Letter from the City Manager regarding adoption <br />of a resolution supporting the application of the Help and <br />Emergency Response Shelter (HER) for designation as a <br />charitable and benevolent organization within the context of <br />Section 6 (a) (6) of Article X of the Constitution of Virginia. <br /> <br /> "The H~lp and Emergency Response (HER) Shelter, a <br />charitable organization, has applied-for exemption from <br />taxation within the context of Section 6(a) of Article X of the <br />Constitution of Virginia. The City Assessor has reviewed the <br />application, and it is his opinion that.the appropriate <br />responses were completed and on that b~sis, the exemption could <br />be granted. <br /> <br /> Property used exclusively by non-profit organizations for <br />religious, charitable, patriotic, historic, benevolent, <br />cultural or public park and playground purposes, however, is <br />not entitled to an automatic tax exemption if acquired <br />subsequent to July 1, 1971. As you well know, almost 60% of <br />the real estate land value in our City is already non-taxable. <br />I have been, and sttll remain, seriously concerned about the <br />impact of any additional non-taxable property and believe we <br />absolutely must reverse this trend. <br /> <br /> While I have no objection in concept, whatsoever, toward <br />this non-profit organization which will provide a safe haven <br />for abused women and children ~n our City, I recommend denial <br />of this request, and future requests, for property tax <br />exemptions." <br /> <br /> Motion of Mr. Griffin and seconded by Mr. Clemons, to <br />table the item, and the City Attorney to investigate whether or <br />not stipulations or limitations can be placed on a tax <br />exemption 'designation, and was adopted by unanimous vote. <br /> <br /> 92-3'65 - Letter from the City Manager recommending <br />adoption of a resolution recognizing concerns about water <br />resources in Southeast Virginia. <br /> <br /> <br />
