April 24. 2007 Next Steps Following Council Action: . City Engineer and Department of General Services will proceed with site preparation and relocation of the Library. Motion by Ms. Randall, and seconded by Mr. R. Smith, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION CONCERNING RELOCATION AND RENOVATION OF THE PORTSMOUTH COMMUNITY LIBRARY. BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager, acting for and on behalf of the City, is authorized and directed to execute the attached Memorandum of Understanding (or one of similar import as approved by the City Attorney) with the African-American Historical Society concerning relocation and renovation of the Portsmouth Community Library. Upon execution of this instrument, the City Manager or his designees shall proceed forthwith to implement all obligations set forth therein. BE IT FURTHER RESOLVED that this resolution shall be effective immediately upon its adoption." Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None 07 - 199 - Adoption of a resolution authorizing the City Manager to execute an agreement for reimbursement of City costs incurred in the construction of a Hampton Roads Sanitation District force main. Vision Principle: Thriving Neighborhoods and a Sense of Community. Background: . Public Utilities is preparing construction plans for the rehabilitation and replacement of water and sewer infrastructure in the Prentis Park neighborhood. . Hampton Roads Sanitation District (HRSD), the regional wastewater treatment authority, has a 24-inch force main located within the City right-of-way of Camden Avenue, in the Prentis Park neighborhood. This force main is over 75 years old, and serves the southeastern portion of the City. Discussion: . HRSD and Public Utilities agree that it is in the best interests of both parties to include the replacement of HRSD's force main as a part of the City proposed improvements. HRSD agrees to reimburse Public Utilities for the cost of the construction related to its force main. . The HRSD Commission has authorized its General Manager to execute the reimbursement agreement on behalf of HRSD. Financial Impact: . HRSD agrees to reimburse Public Utilities for the cost of the construction related to its force main. There is no financial impact on the City. Staff Recommends: Adoption of proposed resolution. The City Manager will execute the Agreement on behalf of the City to allow for HRSD's construction to be included in the City's construction work at the expense of HRSD. . The office of the City Attorney will see to the preparation of appropriate documents to be presented to the City Manager for his execution of this Agreement.
