543 <br />November 24, 1992 <br /> <br />3. That the use permit is approved subject to the following <br />conditions: <br /> <br />(a) <br /> <br />Occupancy shall be limited to no more than <br />twelve (12) persons under the age of twelve <br />(12) months and thirty-one (31) persons over <br />the age of twelve (12) months at any one time. <br /> <br />(b) <br /> <br />The applicant shall comply with the landscaping <br />requirements of Sections 40-71.2(a), (c) and <br />(e) of the Zoning Ordinance. <br /> <br />(c) <br /> <br />The proposed facility will be consuructed to <br />conform with the Site Plan and the North <br />Elevation identified as Exhibits A and B, <br />attached hereto and made a part hereof. <br /> <br />(d) <br /> <br />The applicant shall protect as many mature <br />trees as practicable. Only those trees within <br />the construction footprint of the building and <br />parking lot area may be disturbed. <br /> <br />(e) Vehicular access and egress to the site shall <br /> be limited to Irwin Street. <br /> <br />(f) <br /> <br />Ail outdoor play activities shall be conducted <br />within a fenced area and between the hours of <br />8:00 a.m. and 8:00 p.m. <br /> <br />(g) <br /> <br />Seventeen (17) parking spaces shall be provided <br />to accommodate staff and residents of the <br />facility. <br /> <br />(h) If the subject property becomes non-taxable at <br /> any time, this use permit shall expire. <br /> <br />(~) <br /> <br />The applicant shall comply with all applicable <br />codes~ ordinances, policies and regulations of <br />federal~ state and local governments.
