November 24, 1992 - UNFINISHED BUSINESS - 92-373 Rezoning and Use Permit Applications: Motion of Mr. Epperson and seconded following ordinance and resolution which Public Hearlng on November 9, 1992, were reading and by the following vote: by Mr. Hawks, the were approved at the adopted on final (a) "ZONING AMENDMENT ORDINANCE Z-92-13." (b) "A RESOLUTION GRANTING A USE PERMIT TO HELP AND EMERGENCY RESPONSE (HER) TO OPERATE A RESIDENTIAL CARE FACILITY FOR WOMEN AND CHILDREN AT 82 CHANNING AVENUE. WHEREAS, Horton and Dodd, P.C., has made application on behalf of Help and Emergency Response (HER) pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia, 1988, for granting of a use permit to operate a residential care facility for women and children at 82 Channing Avenue, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described is sought: (a) will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public Use or injurious to the property or improvements in the neighborhood; (c) will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Help and Emergency Response (HER) is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia, 1988, to operate a residential care facility for women and children at 82 Channing Avenue, said property being more particularly described as follows: UP-92-17 Beginning at the southeast intersection of Channing Avenue and Harris Road; thence east along the south right-of-way of Channing Avenue 200' to the west right-of-way of Irwin Street; thence south along said right-of-way 175' more or less to a point; thence west 200.49' to the east right-of-way of Harris Road; thence north along said right-of-way 175' more or less to the south right-of-way line of Channing Avenue, the point of beginning.
