March 27, 2007 WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or InJurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to Insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be In accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Justin Verville is hereby granted a use permit pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (2006) for the operation of a restaurant at 3010 High Street, and being more particularly described as: UP-07-04 All that certain lot, piece or parcel of land, situate, lying and being in the City of Portsmouth, Virginia with the appurtenances thereunto belonging, more particularly described as follows, to wit: Beginning at the point of intersection of the Northern line of County Street with the Western right of way line of Crawford Street; thence running from said point of beginning running South 87 degrees, 11' 34" West along the Northern right of way line of County Street a distance of 91.58 feet to a point; thence running North 3 degrees, 15' 32" West 206.86 feet to a point on the Southern right of way line of King Street; thence running North 87 degrees, 2' 34" East along the Southern right of way line of King Street 90.59 feet to a point; said point being the Southwestern intersection of King and Crawford Streets; thence running South 3 degrees, 31' 50" East along the Western right of way of Crawford Street 207.10 feet to the said point of beginning. The hereinabove described parcel of land contains by survey 18,852 square feet and is shown on that certain plat entitled "Portsmouth Redevelopment and Housing Authority Urban Renewal - Crawford Renewal Project VA R-53 Plat of Parcel 12, City of Portsmouth, Virginia" made by R. Kenneth Weeks, Engineers, dated October 1, 1969. All that certain tract, piece or parcel of land, situate, lying and being in the City of Portsmouth, Virginia, with the appurtenances thereunto belonging, more particularly described as follows, to-wit:
