<br />March 27, 2007 <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or working in <br />the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or InJurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to Insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Justin Verville is hereby granted a use permit pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (2006) for the operation of a <br />restaurant at 3010 High Street, and being more particularly described as: <br /> <br />UP-07-04 <br /> <br />All that certain lot, piece or parcel of land, situate, lying and being in the City of <br />Portsmouth, Virginia with the appurtenances thereunto belonging, more particularly <br />described as follows, to wit: <br /> <br />Beginning at the point of intersection of the Northern line of <br />County Street with the Western right of way line of Crawford <br />Street; thence running from said point of beginning running <br />South 87 degrees, 11' 34" West along the Northern right of <br />way line of County Street a distance of 91.58 feet to a point; <br />thence running North 3 degrees, 15' 32" West 206.86 feet to <br />a point on the Southern right of way line of King Street; <br />thence running North 87 degrees, 2' 34" East along the <br />Southern right of way line of King Street 90.59 feet to a <br />point; said point being the Southwestern intersection of King <br />and Crawford Streets; thence running South 3 degrees, 31' <br />50" East along the Western right of way of Crawford Street <br />207.10 feet to the said point of beginning. The hereinabove <br />described parcel of land contains by survey 18,852 square <br />feet and is shown on that certain plat entitled "Portsmouth <br />Redevelopment and Housing Authority Urban Renewal - <br />Crawford Renewal Project VA R-53 Plat of Parcel 12, City of <br />Portsmouth, Virginia" made by R. Kenneth Weeks, <br />Engineers, dated October 1, 1969. <br /> <br />All that certain tract, piece or parcel of land, situate, lying and being in the City of <br />Portsmouth, Virginia, with the appurtenances thereunto belonging, more particularly <br />described as follows, to-wit: <br />
