<br />March 27, 2007 <br /> <br />Beginning at a point on the North side of County <br />Street 91.58 feet West of the northwest intersection of <br />County and Crawford Streets, thence from said point of <br />beginning running South 87 degrees, 11' 34" West along the <br />North side of County Street 25 feet to a point; thence running <br />North 3 degrees, 15' 25" West 206.78 feet to a point on the <br />South side of King Street; thence running North 87 degrees, <br />2' 34" East along the South side of King Street 25 feet to a <br />point; thence running South 3 degrees, 15' 32" East 206.86 <br />feet to the said point of beginning. The aforesaid tract of <br />land being more particularly shown as Parcel 12A, <br />"Portsmouth Redevelopment and Housing Authority, Urban <br />Renewal - Crawford Renewal Project, VA R-53, City of <br />Portsmouth, Virginia" made by R. Kenneth Weeks, <br />Engineers dated March 5, 1971. <br /> <br />3. That the use permit is approved subject to the following conditions which shall be <br />observed by the applicant and any successor in interest: <br /> <br />(a) No alcohol shall be served on the premises. <br /> <br />(b) The hours of operation shall be Sunday through Thursday from 8:00 am to 12:00 <br />am and Friday through Saturday from 8:00 am to 2:00 am. <br /> <br />(c) The occupancy for the suites and the building shall conform to the Uniform State- <br />wide Building Code, as approved by the City of Portsmouth Building Official. <br /> <br />(d) No amplified music shall be audible to other suites within the building during <br />business hours (8:00 a.m. to 5:00 p.m.) and at the property line after 5:00 p.m. <br /> <br />(e) The establishment shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments. <br /> <br />(f) The applicant shall obtain all required licenses and permits before operation and <br />these licenses and permits shall remain in effect during the operation of the <br />establ ishment. <br /> <br />(g) Taxes and fees associated with the property shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, Holley <br />Nays: None <br /> <br />07-115 (g): <br /> <br />Resolution granting the request of Gene and Lynn Breckenridge for a use permit to <br />provide paid entertainment in the existing Breckenridge Restaurant and Lounge at 448 <br />Green Street. (UP-07 -05) (First Reading Vote 5-0) <br /> <br />Motion by Ms. Randall, and seconded by Ms. Moody, to accept the applicant's <br />withdrawal, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br />
