<br />March 27, 2007 <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Bradley Stewart is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (2006) for the operation of a <br />restaurant at 702 High Street, and being more particularly described as: <br /> <br />UP-07-03 <br /> <br />Beginning at a point 30.05':t west of the northwest corner of Green and <br />High Streets; thence, in a northerly direction 88':t to a point; thence, in a <br />westerly direction 31.85':t to a point; thence, in a southerly direction 88':t <br />to a point; thence, in an easterly direction 31.85':t to a point of the <br />beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The project shall comply with the approved plan entitled Proposed Restaurant <br />702 High Street. <br /> <br />(b) The project shall comply with the proposal for the exterior remodeling approved <br />by the Downtown Design Committee October 3, 2006. <br /> <br />(c) Days and hours of operation shall be limited to Monday through Friday, 10:30 <br />a.m. to 1 :30 a.m. and to Saturday and Sunday, 7:30 a.m. to 1 :30 a.m. <br /> <br />(d) The restaurant shall not accommodate more than 75 persons. The Fire Marshal <br />shall establish final capacity. <br /> <br />(e) The applicant shall obtain and maintain In effect all appropriate permits and <br />licenses for the establishment. <br /> <br />(f) The proposed business shall operate in accordance with federal, state and local <br />codes and regulations. <br /> <br />(g) Trash shall be removed by either City trash pickup or a commercial waste hauler. <br /> <br />(h) All taxes and fees in connection with the proposed use shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />Motion by Mr. Moody, and seconded by Ms. Psi mas, to adopt the following <br />resolution approved on first reading at the March 13, 2007 meeting, and was adopted <br />by the following vote: <br /> <br />07-115 (f): <br /> <br />"RESOLUTION GRANTING A USE PERMIT (UP-07-04)TO JUSTIN VERVILLE TO <br />OPERATE AN EATINGIENTERTAINMENT ESTABLISHMENT AT 600 CRAWFORD <br />STREET. <br /> <br />WHEREAS, Justin Verville has made application pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit for <br />the operation of an eatinglentertainment establishment at 700 Crawford Street , <br />Portsmouth, Virginia; and <br />
