March 27, 2007 (e) Will be In accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Bradley Stewart is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (2006) for the operation of a restaurant at 702 High Street, and being more particularly described as: UP-07-03 Beginning at a point 30.05':t west of the northwest corner of Green and High Streets; thence, in a northerly direction 88':t to a point; thence, in a westerly direction 31.85':t to a point; thence, in a southerly direction 88':t to a point; thence, in an easterly direction 31.85':t to a point of the beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The project shall comply with the approved plan entitled Proposed Restaurant 702 High Street. (b) The project shall comply with the proposal for the exterior remodeling approved by the Downtown Design Committee October 3, 2006. (c) Days and hours of operation shall be limited to Monday through Friday, 10:30 a.m. to 1 :30 a.m. and to Saturday and Sunday, 7:30 a.m. to 1 :30 a.m. (d) The restaurant shall not accommodate more than 75 persons. The Fire Marshal shall establish final capacity. (e) The applicant shall obtain and maintain In effect all appropriate permits and licenses for the establishment. (f) The proposed business shall operate in accordance with federal, state and local codes and regulations. (g) Trash shall be removed by either City trash pickup or a commercial waste hauler. (h) All taxes and fees in connection with the proposed use shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None Motion by Mr. Moody, and seconded by Ms. Psi mas, to adopt the following resolution approved on first reading at the March 13, 2007 meeting, and was adopted by the following vote: 07-115 (f): "RESOLUTION GRANTING A USE PERMIT (UP-07-04)TO JUSTIN VERVILLE TO OPERATE AN EATINGIENTERTAINMENT ESTABLISHMENT AT 600 CRAWFORD STREET. WHEREAS, Justin Verville has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit for the operation of an eatinglentertainment establishment at 700 Crawford Street , Portsmouth, Virginia; and
