<br />February 27,2007 <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or working in <br />the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or InJurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to Insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Verizon Wireless and The Churchland Swim and Racquet Club, <br />Incorporated, are hereby granted a use permit pursuant to Section 40-43.1 of the Code <br />of the City of Portsmouth, Virginia (2006) to construct a telecommunications facility (cell <br />tower) at 3120 Tyre Neck Road, Portsmouth, Virginia, and being more particularly <br />described as: <br /> <br />UP-07-02 <br /> <br />That parcel beginning at a property pin located approximately 35 feet west <br />of the centerline of the existing pavement of Tyre Neck Road; said pin <br />located at the southeast corner of property presently belonging to the <br />Churchland Swim and Racquet Club. Thence, proceeding S 85044'10"E <br />550.02 feet plus or minus, to a point, thence S06034'50"W 179.61 feet <br />more or less to a point, thence, proceeding S85044'1 O"E 550.02 feet more <br />or less to a point thence, S06035'13"W 179.61 feet more or less to the <br />point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Prior to obtaining construction permits, a certified report from a qualified and <br />licensed professional engineer must be submitted to the Director of Planning <br />demonstrating that: <br /> <br />a. The proposed tower will meet the structural requirements of the statewide <br />building code and the requirements of, EIA-222E, Structural Standards for Steel <br />Antenna Towers and Antenna Supporting Structures; <br />b. The non-ionizing electromagnetic radiation (NIER) that will be emitted from the <br />proposed facility, along with others on the same structure or in the immediate vicinity, <br />will not exceed exposure standards of the U.S. Government; and <br />c. The tower will not cause interference with any equipment such as radio, <br />television and computers operated by users on adjacent properties. <br /> <br />(b) The applicant will provide a Major Water Quality Impact Assessment, as <br />suggested by the City Engineering office and required by the Chesapeake Bay Plan of <br />Development Process, which states that any development that produces a land <br />disturbance of greater than 5,000 square feet requires such a Major Assessment to be <br />done. <br />
