February 27,2007 At a Regular Meeting of the City Council on Tuesday, February 27, 2007 there were present: Mayor James W. Holley, III, Vice Mayor Marlene W. Randall, William E. Moody, Jr., Stephen E. Heretick, Elizabeth M. Psi mas, Ray A. Smith, Sr., Douglas L. Smith, City Manager James W. Oliver, City Attorney G. Timothy Oksman. Councilwoman Elizabeth M. Psi mas opened the meeting with prayer which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Ms. Psi mas, and seconded by Mr. R. Smith, to approve the minutes of a Called Meeting on February 12, 2007, of a Called Meeting of February 13, 2007, and of a Regular Meeting on February 13,2007, and were adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None 07 - 95 - Presentations: . Presentation of the National League of Cities 2006 Award for Municipal Excellence to the City of Portsmouth. . Presentation by Councilman Ray Smith of the Special Service Award to Mayor Holley. - Unfinished Business - Consent Aqenda: 1. Marilyn Henderson, 3740 Linnet Lane, spoke in opposition to item 07-71 (g). 07 - 71 - Use permit, housing permit and code amendment: Motion by Mr. Moody, and seconded by Ms. Randall, to adopt the following resolutions and ordinance approved on first reading at the February 13, 2007 meeting, and was adopted by the following vote: 07-71 (d): "RESOLUTION GRANTING A USE PERMIT (UP-07-02) TO VERIZON WIRELESS TO CONSTRUCT A TELECOMMUNICATIONS FACILITY AT 3120 TYRE NECK ROAD. WHEREAS, Verizon Wireless has made application pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit to construct a telecommunications facility on property owned by the Churchland Swim and Racquet Club, Incorporated, at 3120 Tyre Neck Road, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
