February 27,2007 (c) The applicant will submit an erosion and sediment control plan/site plan. (d) The applicant shall obtain a Chesapeake Bay Ordinance Exception for the proposed development. (e) The establishment shall be operated in compliance with all applicable codes, ordinances, and regulations of federal, state, and local governments. (f) The applicant shall obtain all required licenses and permits before operation and these licenses and permits shall remain in effect during the operation of the establ ishment. (g) Taxes and fees associated with the project shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 07-71 (e): "RESOLUTION GRANTING APPROVAL OF A HOUSING USE PERMIT (HP-07-01) TO E.B.C. CORPORATION TO CONSTRUCT A DUPLEX AT 2106-2108 ELM AVENUE. WHEREAS, E.B.C. Corporation, pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia (2006), as amended, has made application for the granting of a housing use permit (HP-07 -01) to construct a duplex at 2106-2108 Elm Avenue, Portsmouth, Virginia; and WHEREAS, the subject property is furthermore described as: HP-07-01 Beginning at a point a the northwest corner of Elm Avenue and Fayette Street; thence, in a northerly direction 100.5':t to a point; thence, in a westerly direction 1 05':t to point; thence, in a southerly direction 1 00.5':t to a point; thence, in an easterly direction 1 05':t to a point of the beginning. and WHEREAS, the Planning Commission has reviewed the submitted application and site plan and has recommended conditional approval of said application; and WHEREAS, the applicant has been informed that approval of the housing permit pursuant to Section 40-116 only grants an exemption from certain requirements for residences as stated in said section and does not constitute a waiver of any other requirement embodied in the City Subdivision Ordinance, the City Zoning Ordinance, or any other applicable local, state or federal law or regulation; and WHEREAS, the applicant is aware that building permits and any other required permit will be issued only upon compliance with the ordinances, laws or regulations applicable thereto.
