Smith, to adopt the following
ordinance, and was adopted by the following vote:

"ORDINANCE TO APPROPRIATE AN ADDITIONAL $85,824 IN THE FY 2006-2007
BEHAVIORAL HEAL THCARE SERVICES FUND OPERATING BUDGET FOR THE
PURCHASE OF COMPUTER EQUIPMENT AND VEHICLES."

Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley
Nays: None

07 - 21 - Adoption of an ordinance to amend Chapter 16 of the Code of the City of
Portsmouth, Virginia (2006) by amending Section 16-64 thereof and by amending
Appendix A thereof to increase monthly rates for trash and garbage disposal. Vision
Principle: Thriving Neighborhoods and a Sense of Community.

Background:
. To begin to resolve its financial crisis, the Southeastern Public Service Authority
(SPSA) passed a resolution on October 25, 2006 to raise tipping fees to $75 per ton
effective January 1, 2007, which represents an $18 per ton increase in FY-07 over
SPSA's current $57 per ton tipping fee.
. SPSA is also projecting that on July 1, 2007 tipping fees may increase an
additional $15 per ton to $90 per ton, which will increase operating costs of the City's
Waste Management Fund in FY-08.
. Additionally, the City's landfill has incurred a $5.5 million long-term liability for
future closure and post-closure costs resulting from the operation and maintenance of
the landfill.

Discussion:
. The City's ability to cover the additional costs resulting from the SPSA tipping fee
increase and the City landfill operations is dependent upon increasing the Solid Waste
Service Charge rate being billed to its 32,780 residents and businesses.
. City's Waste Management Fund Operating Budget must increase by $781,220 to
fund both SPSA's rate increase and the City's landfill liability, which translates into an
average rate increase of approximately $4 per month over the remaining six months of
FY -07.

Financial Impact:
. $4 increase in the monthly rate (from $22 per month to $26 per month) for Solid
Waste Service Charges billed to Portsmouth residents and businesses.
. $781,220 increase in estimated revenues and appropriated expenditures in the
Waste Management Fund Operating Budget.

Staff Recommends:
Adoption of proposed ordinances. Vision Principles: Thriving Neighborhoods and a
Sense of Community and A Robust and Prospering Economy.

Next Steps Following Council Action:
. The CFO will coordinate with the Directors of General Services and IT to ensure
the proper and timely implementation of the Solid Waste Service Charge rate increase
effective January 1, 2007.
. The CFO will ensure the appropriate budget action is processed for the Waste
Management Fund.
