Smith <br />Nays: Holley <br /> <br />07 - 23 - Adoption of a resolution authorizing the City Manager to vacate a certain utility <br />easement that exists in a closed and vacated portion of Griffin Street lying between Fifth <br />Street and property now owned by CSX Transportation, Inc., formerly Seaboard Coast <br />Line Railroad. Vision Principle: Bold New Directions. <br /> <br />Background: <br />. At the request of PRHA, Griffin Street was closed and vacated by ordinance <br />adopted by the Council of the City of Portsmouth at a meeting held on September 11, <br />1973. This ordinance further reserved a utility easement in that portion of Griffin Street <br />being closed. <br /> <br />Discussion: <br />. It has been determined that no utilities exist within this easement area and there <br />are no proposed plans to install utilities with this easement area. There is no further <br />need for this easement. <br />. This property is now owned by Gerdua International, Inc. but will be conveyed to <br />the Economic Development Authority of the City of Portsmouth, Virginia in the near <br />future and is being actively marketed. <br /> <br />Financial Impact: <br />. The release of this easement will allow for the sale and development of this <br />property. <br /> <br />Staff Recommends: <br />Adoption of proposed resolution. Vision principle: Bold New Directions. <br /> <br />Next Steps Following Council Action: <br />. The City Manager will execute the Deed of Release and any other required <br />documents on behalf of the City to complete the release of the easement. <br />. The office of the City Attorney will see to the preparation of appropriate <br />documents to be presented to the City Manager for his execution releasing the reserved <br />easement. <br /> <br />Motion by Mr. D. Smith, and seconded by Mr. R. Smith, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO VACATE A CERTAIN <br />UTILITY EASEMENT THAT EXISTS IN A CLOSED AND VACATED PORTION OF <br />GRIFFIN STREET LYING BETWEEN FIFTH STREET AND PROPERTY NOW <br />OWNED BY CSX TRANSPORTATION, INC. FORMERLY SEABOARD COAST LINE <br />RAILROAD. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and he hereby is, authorized to execute a Deed of Release to the <br />Economic Development Authority of the City of Portsmouth, Virginia to vacate an <br />easement in a portion of Griffin Street lying between Fifth Street and property now <br />owned by CSX Transportation, Inc., formerly Seaboard Coast Line Railroad and any <br />other required documents on behalf of the City to complete the release of the <br />easement. " <br />
