January 9. 2007 "ORDINANCE TO AMEND THE CITY'S FY 2006-2007 WASTE MANAGEMENT FUND OPERATING BUDGET BY APPROPRIATING AN ADDITIONAL $781,220 FROM FUNDS RECEIVED AS A RESULT OF AN INCREASE IN SOLID WASTE FEES." Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith Nays: Holley 07 - 23 - Adoption of a resolution authorizing the City Manager to vacate a certain utility easement that exists in a closed and vacated portion of Griffin Street lying between Fifth Street and property now owned by CSX Transportation, Inc., formerly Seaboard Coast Line Railroad. Vision Principle: Bold New Directions. Background: . At the request of PRHA, Griffin Street was closed and vacated by ordinance adopted by the Council of the City of Portsmouth at a meeting held on September 11, 1973. This ordinance further reserved a utility easement in that portion of Griffin Street being closed. Discussion: . It has been determined that no utilities exist within this easement area and there are no proposed plans to install utilities with this easement area. There is no further need for this easement. . This property is now owned by Gerdua International, Inc. but will be conveyed to the Economic Development Authority of the City of Portsmouth, Virginia in the near future and is being actively marketed. Financial Impact: . The release of this easement will allow for the sale and development of this property. Staff Recommends: Adoption of proposed resolution. Vision principle: Bold New Directions. Next Steps Following Council Action: . The City Manager will execute the Deed of Release and any other required documents on behalf of the City to complete the release of the easement. . The office of the City Attorney will see to the preparation of appropriate documents to be presented to the City Manager for his execution releasing the reserved easement. Motion by Mr. D. Smith, and seconded by Mr. R. Smith, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION AUTHORIZING THE CITY MANAGER TO VACATE A CERTAIN UTILITY EASEMENT THAT EXISTS IN A CLOSED AND VACATED PORTION OF GRIFFIN STREET LYING BETWEEN FIFTH STREET AND PROPERTY NOW OWNED BY CSX TRANSPORTATION, INC. FORMERLY SEABOARD COAST LINE RAILROAD. BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to execute a Deed of Release to the Economic Development Authority of the City of Portsmouth, Virginia to vacate an easement in a portion of Griffin Street lying between Fifth Street and property now owned by CSX Transportation, Inc., formerly Seaboard Coast Line Railroad and any other required documents on behalf of the City to complete the release of the easement.
