April 13, 1993 063 Motion of Mr. Epperson and seconded by Mr. King, for the award of the contract to the lowest responsible bidder, Absolute Enterprise, Inc. and was adopted by the following vote: AYES: Clemens, Epperson, Griffin, Hawks, King, Pitts, Webb - NAYS: None 93-139 Letter from the City Manager recommending adoption of a resolution recommending the vacatio9 of utility easements in the Cclumbia Commons Subdivision and congeyance of all title and interest to the"adjoinin~ property owneri. "Portions of Columbia and Green Streets have previously been vacate to facilitate the development of the Columbia Commons Subdivision, at which time utility easements were reserved. These utilities have now been relocated as part of the development process for this project. The Director of Public Works recommends the vacating of these easements and that the City convey any a~d all title and interest it has in. these easements to the adjoining!J property owners. I, therefore, concur and recommend the vacation of the aforementioned utility easements." I M~tion of Mr. Griffin and seconded ~y Mr. Clemens,. the following resolution was adopted by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO VACATE AND RELEASE EASEMENTS FOR PUBLIC UTILITIES LYING WITHIN CLOSED PORTIONS OF COLUMBIA STREET AND GREEN STREET. WHEREAS, the Council of the City o~ Portsmouth, Virginia, closed portioBs of Columbia Street and ~reen Street by ordinance adopte~ on January 12, 1993; and ?~HEREAS, the Council of the City of Portsmouth, Virginia, reserved easements for the installation ~nd maintenance of public utilities ~n those portions of the close~ rights-of-way; and WHEREAS, the City's Department of P~blic utilities has completed all work necessary to the abandonment of its facilities withi~ said easements, and the easements formerly reserved are no longe~ required for public purpose. OW, THEREFORE, BE IT RESOLVED by t~e Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby ~s authorized to execute any and all such documents as may be necessary to ~elease and vacate easement~ reserved by the City of Portsmouth for public utilities on the f~llowing described property, to-wit: Beginning at the intersection of ~he west rlgnt-of-way line of Green Street (wnlch portion is now closed) w~th. the south right-of-way line of County street; tnence east along the south rig~t-of-way line of County Street a distance of 60.~4' to its intersection wit~ the east rig~t-of-way line of Green Street; thence south along the east right-of-way line of ~reen Street a distance of ~27.49' to its intersection with the north ri~t-of-way line of Columbia Street (which portion is now closed); thence east along the north
