April 13, 1993 <br /> <br />063 <br /> <br /> Motion of Mr. Epperson and seconded by Mr. King, for the <br />award of the contract to the lowest responsible bidder, Absolute <br />Enterprise, Inc. and was adopted by the following vote: <br /> <br /> AYES: Clemens, Epperson, Griffin, Hawks, King, Pitts, Webb <br />- NAYS: None <br /> <br /> 93-139 Letter from the City Manager recommending adoption <br />of a resolution recommending the vacatio9 of utility easements in <br />the Cclumbia Commons Subdivision and congeyance of all title and <br />interest to the"adjoinin~ property owneri. <br /> "Portions of Columbia and Green Streets have previously been <br />vacate to facilitate the development of the Columbia Commons <br />Subdivision, at which time utility easements were reserved. These <br />utilities have now been relocated as part of the development <br />process for this project. <br /> <br /> The Director of Public Works recommends the vacating of these <br />easements and that the City convey any a~d all title and interest <br />it has in. these easements to the adjoining!J property owners. <br /> I, therefore, concur and recommend the vacation of the <br />aforementioned utility easements." I <br /> M~tion of Mr. Griffin and seconded ~y Mr. Clemens,. the <br />following resolution was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO VACATE AND RELEASE <br />EASEMENTS FOR PUBLIC UTILITIES LYING WITHIN CLOSED PORTIONS OF <br />COLUMBIA STREET AND GREEN STREET. <br /> <br /> WHEREAS, the Council of the City o~ Portsmouth, Virginia, <br />closed portioBs of Columbia Street and ~reen Street by ordinance <br />adopte~ on January 12, 1993; and <br /> <br /> ?~HEREAS, the Council of the City of Portsmouth, Virginia, <br />reserved easements for the installation ~nd maintenance of public <br />utilities ~n those portions of the close~ rights-of-way; and <br /> <br /> WHEREAS, the City's Department of P~blic utilities has <br />completed all work necessary to the abandonment of its facilities <br />withi~ said easements, and the easements formerly reserved are no <br />longe~ required for public purpose. <br /> <br /> OW, THEREFORE, BE IT RESOLVED by t~e Council of the City of <br />Portsmouth, Virginia, that the City Manager be, and he hereby ~s <br />authorized to execute any and all such documents as may be <br />necessary to ~elease and vacate easement~ reserved by the City of <br />Portsmouth for public utilities on the f~llowing described <br />property, to-wit: <br /> <br />Beginning at the intersection of ~he west <br />rlgnt-of-way line of Green Street (wnlch portion is <br />now closed) w~th. the south right-of-way line of <br />County street; tnence east along the south <br />rig~t-of-way line of County Street a distance of <br />60.~4' to its intersection wit~ the east <br />rig~t-of-way line of Green Street; thence south along <br />the east right-of-way line of ~reen Street a distance <br />of ~27.49' to its intersection with the north <br />ri~t-of-way line of Columbia Street (which portion <br />is now closed); thence east along the north <br /> <br /> <br />
