November 28. 2006 Background: . On February 15, 2006 the Commissioner of the Revenue's office received the 2006 Tangible Tax return from Dail's Hardware Inc. . On May 18, 2006 Dail's Hardware Inc. paid their tax bill in the amount of $29,467.30. . On August 14, 2006 Dail's Hardware Inc. sent notification, via fax, appealing the assessment for 2006 and detailing their rental items that were reported in error. . On October 20, 2006 the Commissioner reviewed Dail's account and corrected the assessment resulting in an overpayment of $19,532.45. Discussion: . Dail's Hardware Inc. erroneously reported rental equipment on their 2006 Tangible Tax return. Subsequently, this equipment was assessed and billed as reported. The associated tax bills were paid in full. As a result of a verification process, the taxpayer requested a refund of the over paid amount. Per Ms. Dail's request, as a taxpayer advocate, the Commissioner of the Revenue's office is requesting Council's consideration and action in resolving this concern. Financial Impact: . Overpayment of Business Personal Property Taxes paid to Dail's Hardware Inc. in the amount of $19,532.45. Staff Recommends: Adoption of proposed ordinance. Smith, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE AUTHORIZING THE REFUNDING OF $19,532.45 TO DAIL'S HARDWARE, INC., FOR BUSINESS PERSONAL PROPERTY TAXES ERRONEOUSLY PAID THEREON DURING CALENDAR YEAR 2006." Smith, Holley Nays: None 06 - 545 - Adoption of a resolution authorizing the City Manager to execute two Deeds of Easements to Hampton Roads Sanitation District for underground wastewater andlor water reuse force mains andlor gravity mains together with above andlor below ground equipment, accessories, and appurtenances thereto for property located at the Mt. It has been determined by the Hampton Roads Sanitation District (HRSD) that a sewer line belonging to HRSD is partially located beneath a wing of the Mt. Hermon School. HRSD has determined that this line should be relocated and has submitted plans for its relocation. Discussion: . A new line will be placed within an easement 30' in width which will be located adjacent to Glasgow Street. . Two of the parcels necessary for said easements are in the name of the School Board and two are in the name of the City. . The School Board has authorized execution of two easements over the School Board parcels by the Chairman of the School Board and by Resolution has approved execution of the two easements affecting City property by the City Manager and hereby requests that the City Manager execute said easements.
