<br />November 28. 2006 <br /> <br />Background: <br />. On February 15, 2006 the Commissioner of the Revenue's office received the <br />2006 Tangible Tax return from Dail's Hardware Inc. <br />. On May 18, 2006 Dail's Hardware Inc. paid their tax bill in the amount of <br />$29,467.30. <br />. On August 14, 2006 Dail's Hardware Inc. sent notification, via fax, appealing the <br />assessment for 2006 and detailing their rental items that were reported in error. <br />. On October 20, 2006 the Commissioner reviewed Dail's account and corrected <br />the assessment resulting in an overpayment of $19,532.45. <br /> <br />Discussion: <br />. Dail's Hardware Inc. erroneously reported rental equipment on their 2006 <br />Tangible Tax return. Subsequently, this equipment was assessed and billed as <br />reported. The associated tax bills were paid in full. As a result of a verification process, <br />the taxpayer requested a refund of the over paid amount. Per Ms. Dail's request, as a <br />taxpayer advocate, the Commissioner of the Revenue's office is requesting Council's <br />consideration and action in resolving this concern. <br /> <br />Financial Impact: <br />. Overpayment of Business Personal Property Taxes paid to Dail's Hardware Inc. <br />in the amount of $19,532.45. <br /> <br />Staff Recommends: <br />Adoption of proposed ordinance. Vision Principle: A Robust and Prospering Economy. <br /> <br />Next Steps Following Council Action: <br />. Refunding $19,532.45 to Dail's Hardware Inc. <br /> <br />Motion by Mr. Moody, and seconded by Mr. R. Smith, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE AUTHORIZING THE REFUNDING OF $19,532.45 TO DAIL'S <br />HARDWARE, INC., FOR BUSINESS PERSONAL PROPERTY TAXES <br />ERRONEOUSLY PAID THEREON DURING CALENDAR YEAR 2006." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />06 - 545 - Adoption of a resolution authorizing the City Manager to execute two Deeds <br />of Easements to Hampton Roads Sanitation District for underground wastewater andlor <br />water reuse force mains andlor gravity mains together with above andlor below ground <br />equipment, accessories, and appurtenances thereto for property located at the Mt. <br />Herman school site. Vision Principle: Bold New Directions. <br /> <br />Background: <br />. It has been determined by the Hampton Roads Sanitation District (HRSD) that a <br />sewer line belonging to HRSD is partially located beneath a wing of the Mt. Hermon <br />School. HRSD has determined that this line should be relocated and has submitted <br />plans for its relocation. <br /> <br />Discussion: <br />. A new line will be placed within an easement 30' in width which will be located <br />adjacent to Glasgow Street. <br />. Two of the parcels necessary for said easements are in the name of the School <br />Board and two are in the name of the City. <br />. The School Board has authorized execution of two easements over the School <br />Board parcels by the Chairman of the School Board and by Resolution has approved <br />execution of the two easements affecting City property by the City Manager and hereby <br />requests that the City Manager execute said easements. <br />
