May 25, 1993 Ayes: Clemons,~Epperson, Nays: Hawks, King (g). The applicants or any successors in interest shall construct and maintain, at no cost to the City, a six (6) foot high wooden privacy fence on the applicants' property so as to separate applicants' property from portions of the subdivisions of Willow Breeze and Merrifields, Section 9. Said fence shall extend along the eh%ire length of the applicants' property line from 10 Gateway Court to t Hardwood Court, as generally shown on Exhibit A, attached hereto and made a.part hereof and shall also extend across the land situated between the two above-mentioned roadway terminations. (h) The applicants shall comply with all applicable codes, ordinances, and regulations of federal, state, and local governments and shall obtain all necessary licenses and permits." Griffin, Pitts, Webb 93-191 (n) Ordinance to amend the Code of Portsmouth, Virginia, 1988, by amending Sections 30-237(b) thereof, pertaining to retirement. the City of 30-117(g) and Motion of Mr. Epperson, and seconded by Mr. Hawks, the following ordinance was adopted and by the following vote: "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 30-117(g) AND 30-237(b) THEREOF, PERTAINING TO RETIREMENT~ Ayes: Epperson, Griffin, Hawks, King, Pitts, Webb Nays: Clemons - CITY MANAGER'S REPORT - 93-207 Letter from the City Manager recommending adoption of an ordinance to appropriate $303,125 from the Capital Improvements Fund for cover soil at the Craney Island Landfill and award of the bid to the lowest responsible bidder, Whit Williams, Inc. "The 1992/93 Capital Improvement Plan authorized continued funding for the closure of an 85 acre section of Craney Island Landfill. Virginia Waste Management regulations require disposed material to be covered on a daily basis with an intermediate cover material before a final cover material is applied. Bids for the daily cover soil have been received and a listing of bidders is attached for your review. The Director of General Operations recommends that the low bidder, Whit Williams, Inc., be awarded the bid in the amount of $242,500 plus an additional 25% added for contingencies. I concur with this recommendation and request appropriation in,the amount of $303,125. With your approval of this item, the balance in the Capital Improvements Fund will be $12~546,204." Motion of Mr. Clemons and seconded by Mr. Pitts, the following ordinance was adopted and by the following vote: "AN ORDINANCE TO APPROPRIATE $303,125.00 FROM THE CAPITAL IMPROVEMENTS FUND FOR COVER MATERIAL FOR THE CRANEY ISLAND LANDFILL"
