May 25, 1993 <br /> <br />103 <br /> <br />(C) The project ~s a whole conforms to applicable requirements <br />for minimum required floor area for dwelling usitsr minimum <br />allowable area for dwelling units, maximum allowable area for the <br />numbe~ of dwelling units, and the maximum allowable area devoted <br />to residential purposes; <br /> <br />(d) <br /> <br />The quantity, quality, utility, size and type of the <br />project's open space and landscaping improvements is <br />sufficient to offset the decreases in dimensional <br />requirements or other deviations from the zoning district <br />which the project is located; <br /> <br />in <br /> <br />(e) <br /> <br />The project's internal traffic circulation system is adequate <br />to provide for the convenient and safe movement of vehicles <br />and pedestrians, and the project will not cause surrounding <br />streets and roads to exceed their safe capacities; <br /> <br />(f) <br /> <br />The quantity, quality, utility and type of the project's <br />community and common facilities are sufficient to offset the <br />decreases in dimensional requirements and other deviations <br />from the zoning district in which the project is located; <br /> <br />(g) The project pomplies with the standards for approval of a use <br /> permit set forth in Section 40-106 Of the Code of the City of <br /> Portsmouth, Virginia; and <br /> <br />(h) <br /> <br />The project provides parking, building access and pathways <br />for persons with disabilities in accordance with the <br />requirements of the Americans with Disabilities Act. <br /> <br /> 2. That a group housing use permit for the construction of <br />eighty (80) apartment units on Gateway Drive on a portion of Tax <br />Map 846, Parcel 3.4 is hereby granted to Newman Associates subject <br />to the following terms and conditions: <br /> <br />(a) The proposed group housing project shall be limited to a <br /> maximum of eighty (80) units. <br /> <br />(b) <br /> <br />A subdivision plat vacating the property line adjacent <br />to Westwinds I must be approved by the City of <br />Portsmouth and shall be recorded prior to issuance of <br />any building permits. <br /> <br />(c) <br /> <br />ExcavatIon of the area to become hardwood preserves <br />between the proposed multi-family project and the <br />subdivision of Merrifields, Section 9, shall be <br />completed prior to 50% occupancy of the project. <br /> <br />(d) <br /> <br />A revised site plan, landscapzng plan and elevations <br />reflecting all changes and conditions made through the <br />group housing project application process, including any <br />c~nditions imposed and changes made by City Council, <br />shall b~ submitted to and approved by the Planning <br />Department prior to the issuance of building permits. <br /> <br />(e) The apartment buildings shall be constructed in <br /> accordance with the submitted elevations. <br /> <br />(f) <br /> <br />The applicants shall~ at no expense to the City, cause <br />to be Installed two roadway terminations of a <br />configuration as may be allowable under the Subdivision <br />Ordinance on that portion of Gateway Drive that is <br />contiguous to the area of land for which this Group <br />Housing Permit application is made in order to.control <br />motor vehicle traffic. <br /> <br />! <br /> <br /> <br />
