May, 25, 1993 <br /> <br /> (B) (GHP-93-01) Motion by Mr. Clemons, and seconded by Mr. <br />Pitts, the following resolution, approved at the Public Hearing <br />of May 12, 1993, was adopted and by the following vote: <br /> <br /> J. Gregory Dodd, 164 S. George Washington Highway, <br />representing Horton & Dodd, spoke in favor of the use permit <br />application. <br /> <br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE <br />PERMIT (GHP-93-1) TO PERMIT CONSTRUCTION OF EIGHTY (80) <br />APARTMENT UNITS ON GATEWAY DRIVE ON A PORTION OF TAX MAP 846, <br />PARCEL 3.4. <br /> <br /> WHEREAS, the applicants, Newman Associates, have made <br />application pursuant to Section 40-112 of the Code of the City <br />of Portsmouth, Virginia, 1988, as amended~ for the approval and <br />granting of a group housing use permit for the constructiOn of <br />eighty (80) apartment units on Gateway Drive on a portion of <br />Tax Map 846, Parcel 3.4, more particularly described as <br />follows: <br /> <br /> GHP-93-1 <br /> <br />ALL THAT certain lot, piece or parcel of land, with the <br />appurtenances thereto, situate in the City of Portsmouth, <br />Virginia, being shown as PARCEL tB-3 on that certain plat, <br />consisting of two (2) Sheets, entitled "SUBDIVISION OF <br />PARCEL lB TOWNE POINT PLAZA," dated August 1, 1989, <br />prepared by Horton & Dodd, P.C. and duly recorded in the <br />Clerk's Office of the Circuit Court of the City of <br />Portsmouth, Virginia, in Map-Book 15 at page 17; said <br />PARCEL lB-3 containing 5.5308 acres situate on the south <br />side of Gateway Drive, and of the dimensions shown on said <br />plat; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />the group housing project pursuant to Section 40-116 grants <br />only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinancet Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW~ THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. ~That coupled with the terms imposed by paragraph ~2 <br />herein the following conditions exist: <br /> <br /> (a) The proposed project is compatible with <br />surrounding land uses; <br /> <br /> (b) The density of the project does not exceed the <br />maximum allowable density for the zoning district, and, where <br />applicable, the floor-area ratio of the project does not exceed <br />the maximum allowable floor-area ratio for the zoning district; <br /> <br />, I <br /> <br /> <br />
