January 9, 2001 <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Benn, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY THAT CITY <br />PROPERTY KNOWN AS 344 EFFINGHAM STREET TO THE INDUSTRIAL <br />DEVELOPMENT AUTHORITY OF THE CITY OF PORTSMOUTH, VIRGINIA. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and he hereby is, authorized to convey to the Industrial Development <br />Authority of the City of Portsmouth, Virginia that property described as 344 Effingham <br />Street by such deed or deed as he may deem appropriate, and to execute such other <br />documents, plats and subdivisions as may be required to give effect to this resolution." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />01 - 18 - Adoption of a resolution authorizing the City Manager to surrender, release <br />and quitclaim all its right, title and interest in utility easements in a closed portion of <br />Clifford Street in the area adjacent to the former Riddick-Weaver Elementary School. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution authorizing the City Manager to surrender, release and <br />quitclaim all its right, title and interest in utility easements in a closed portion of Clifford <br />Street adjacent to the former Riddick-Weaver Elementary School site. <br /> <br />Purpose and Need: <br /> <br />· While there appears to be no reservation of an easement by the City in the closed <br />street, and no grant of an easement to the City for an easement in the area, City <br />facilities remained until recent redevelopment in the area. <br /> <br />· The area so affected is now subject to a claim of a prescriptive easement by usage <br />for a period of 32 years. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact for this item. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO SURRENDER, <br />RELEASE AND QUITCLAIM ALL ITS RIGHT, TITLE AND INTEREST IN <br />UTILITY EASEMENTS IN A CLOSED PORTION OF CLIFFORD STREET. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Manager be, and he hereby is authorized to surrender, release and quitclaim to <br />Portsmouth Redevelopment and Housing Authority the following described utility <br />easements, as follows: <br /> <br /> All those certain utility easements including water, sewer, gas and <br />drainage easements located within the closed portion of Clifford Street closed <br />by Ordinance of the Council of the City of Portsmouth, Virginia on March 14, <br />1968, from the western right of way line of Crabapple Street east to the right of <br />way line of Thomas Circle." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />01 - 19 - Adoption of a resolution authorizing the City Manager to convey an easement <br />adjacent to the City Compound to Columbia Gas to be used to service the Compound. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution authorizing the City Manager to convey an easement <br />adjacent to the City Compound to Columbia Gas. <br /> <br /> <br />
